In my state if they have the car for 30 consecutive days then I can use the lemon law it states that they can then buy back or swap the truck or it forces them to do that and then they can charge me for the time I had the car which was right around two weeks and they can also not refund sales tax which I could still claim on my taxes and I had a trade so didnt pay much for sales tax anyway....

The Lemon Law process takes time - lots of time - and it is the owner's choice if they want to invoke it. I'm not sure I would if they are going to help him out. But, lawyers love LL claims because we generally get a lot of fees and always go after the manufacturer to pay them. I just advise people to give the manufacturer a chance to make it right. Is that so bad?

Lets see I had my transmission fluid filled, new plastic dash piece replaced that was a day. Had 2 rear differentials replaced, each taking about a week. So ya I've been down that road. Difference was how I handled it and what I thought I deserved. I let my dealer do they're part, fix my truck, and then I did my part as a customer and reached out to Toyota to GIVE THEM A CHANCE to do right by me as a customer. I didn't throw a fit the first time or even the 2nd time. But what do I know.

All of your time to fix 3 issues will add up to my time for one...and Im not pitching a fit I exchanged calls and emails with the gm and toyota customer service and will continue to do so until a resloution is reached even if I keep the same truck im going to have them lift it and inspect it with me and we will all take our time to make sure everything looks right so I havent been irate or unreasonable with anyone I have asked for what I feel is fair and will continue to do so....

This whole time you've been saying what you feel is only fair is a new truck instead, or did I miss something? Along with dogging the dealer for not doing that for you and talking about going to Twitter to talk about it.

So if I am understanding this correctly, the following is how this process should work for OP.

Place a call to corporate to voice his concerns,
Let the dealer do their job of replacing the engine,
Hope that the dealer has the truck over 30 days,
Take the truck back and file Lemon Law,
Wait for months for this process, all while driving his Lemon Truck,
Finally get a new truck after months of stress.

    Or,

Place a call to corporate to voice his concerns,
Let the dealer do their job,
Take truck back and enjoy the rest of his life.

I've helped friends swap GM V8s. Those things were designed before the wheel was invented and never really changed since, so they're very simple, but the principle is the same. The 3.5 in the Tacoma probably just has some more emissions stuff and electrical connectors for additional sensors.

I understand he is ticked. I would be too. The issue is what should be the resolution? Should he get a new truck because a major mechanical component failed or should he allow Toyota to repair it under warranty? I generally never say what I do for a living on forums but did earlier. I have been an attorney for maybe too long. :) If it was me I would work with the manufacturer and dealer to get this fixed and fixed right. A complete engine swap will also likely result in a free extended warranty that will probably be twice as long as the current warranty. That is not a bad deal. If someone goes lemon law then so be it but with this truck being so new I'm not sure I see a huge benefit other than a smaller deduction for mileage but if you work with the manufacturer they are generally quick to waive mileage deductions.

    LS1 swap with nitros.
Let them fix the truck, under warranty. Be glad the issue happened now and not at 37k miles. It absolutely sucks but as long as they swap the motor and don't cause any additional damage then you should be in good shape. Plus a free extended warranty.

If Toyota blows the timeline, and they may, be 110% ready with LL paperwork. They owe you the fix under warranty but if they cannot deliver then you have consumer protection laws to support you.

I'm curious if this will work out like the first few FR-S/GT86 engine failures where Toyota sent a new long block and corporate Master Techs to install them because they were so new.

You do have a defamatory post a few pages back. It would really be best for you to stop posting about the truck. I know it's hard, you thought you'd found the one and it's been sitting at a dealer waiting for a long block assembly for 12 or 13 days now, but it best to not be posting about it in forums or on social media. There is a common theme among the guys who've had the vehicles replaced and that was patience. You may not be the only one waiting on day 31, your dealer may also be waiting on day 31 so they can file an insurance claim and a dealer reimbursement claim to Toyota.

Have you ever pulled a motor before? And I'm not asking about a standard tree fidy chevy that everyone's pulled.

Your experience has me worried about my 2016 because the wife drive it 4 miles per day and ours would fail on the start of a vacation, you know is like west Texas or New Mexico on our way to Colorado or Arizona.

    No such thing.:drunk:

OP, you should listen to this guy.

Hey man, I gotta stop you right there because your mind is all over the road right now. You're really getting a 'new' engine block, not a rebuilt one in the typical sense.

Ya gotta stop chasing the thought of having a new truck replaced for free, they told you as clear as day that is not an option unless you pay as a trade-in.

I'd be bullshit just as you are, buy you can't have what they refuse to give you, so don't get all wound up this weekend only to go in there Monday morning with your veins bulging out from your neck and forehead..... relax bud.

.... politely ask for an extended warranty for the inconvenience.
