i have a question for you, TW.

the other day i was watching the news and an attorney for a guy who killed his grandfather and gave a confession afterwards (properly confessed, signed forms, etc.), is trying to get that evidence supressed. arguing that because the guy was in the cold for a long time he wasn't in a clear state of mind.

there have been a lot of crazy defenses out there, some work..

what are your thoughts on defense attorneys?

what do you think happens when a defense attorney specializing in DUI defense has a family member that is killed by a drunk driver?

after getting OJ off the hook, did those attorneys feel good about themselves?

i'm all about protecting our rights but... what do you think?

There is a special corner of hell reserved for some, but not all, defense attorneys.

The same could be said for prosecutors. And what about defense attorneys who are not good enough?

Innocent people are put to prison because of overzealous prosecution, misidentified eyewitness accounts, police mistakes, or invalid forensics.

Since DNA technology has emerged, hundreds of innocent people have been exonerated, and at least a dozen people who were put to death, have been identified as innocent.

the system is not perfect, and I prefer to stay as far away from it as possible.

I agree that every person should have their day in court and have the best attorney possible. With that being said, there is a huge difference between 1)DEFENDING someone and 2) Getting them off by any means necessary.

here is my take; i think defense attorney are SOOO important. that is their job to poke holes, get clients off on technicalities..whatever. why? so the cops are forced to do everything perfect! imagine a world where cops get to take all necessary steps to solve crimes...innocent folks would burn. it is a system of checks/balances. it has to be this way, so good guys get protections. the downside? badguys get the same protection.

cops have to keep it clean. i like it that way.

Betcha there are a lot more people who get off on blatant offenses (like DUIs) then cops who have to set up innocent folks. The majority of criminals are dumb fucks and make it pretty easy to nail them.

Good defense attorneys who defend the rights of their clients is one thing.
Scum sucking bastards who make cases disappear based on a 5 min time discrepancy or some other such bullshit don't help anyone. In fact they regularly let folks who endanger others go out and continue their irresponsible behavior....infringing on law abiding citizens right to "Life, liberty, and the pursuit..."

PS-The problem lies in the system but I don't wanna get into that right now...

You are equating technicalities and getting someone off at all costs. They are 2 very different things. If an officer made a mistake, then by all means let it show...but for a defense attorney to get someone off by concocting a BS story is wrong.

If an officer gets on the stand and lies, it's called perjury. If a defense attorney lies, it's called a defense. Both should be held to the same standards!

And exactly what protection do the good guys get? They are already handcuffed by the law. What rules do defense attorneys have to play by? The answer is NONE...You ask to imagine a world where cops could get all the necessary steps to solve a crime? Guess what, we live in a society where the criminals have more rights and defense attorneys can use all necessary steps to get their client off.

You said you like that cops have to keep it clean. Why shouldn't the defense attorneys have to do the same?

Been employed by the 4th largest police dept in the US for 15 years, mostly in narcotics based squads. I have testified in municipal, county, district & federal court hundreds of times. I can't begin to tell you how many times the focus has been shifted away from the facts & how many crazy stories I've encountered. Yeah, I have a little experience dealing w/ def attys
