Exactly. I prefer the listen more talk less approach and don't mind being called sneaky later.

The dealer knows the law as a matter of fact the gm is a relative of the owner and an attorney so im sure they are aware of it and I didnt tip my hand as a matter of fact I didnt even call them much so I doubt anything I did made them work on it sooner than otherwise...& if I have to take it back then it can still be a lemon...as far as the parts they are all new so all new short block all new cams pistons etc no rebuild or refurbished parts according to dealer everything is new from toyota direct....however as we speak I am looking at a different brand of truck and may still trade it off...

So it was or was not a create motor? Kinda just a plug & play swap?

& I don't blame you man. There's little incentive in buying a new Toyota when you have done to you what you've had done.

As I have said many times, I really hope this works out for you and that this is the end of it. Maybe you will be on here 10 years from now bragging that you have the second greatest third gen ever made. I say second because I hope mine is the best!

I will get a list of parts used etc on monday but im sure they prob reused all the accessories like the alt. Compressor and the rest but the engine itself is new....now just have to see how its all hooked up and make sure no leaks....no alignment issues....no missing paint or rust proofing....I told them I would be taking my time on Monday looking it over so I wont be rushed....:transformer:

Exactly. Toyota has met their responsibilities in this case and yes, it can take a while to rebuild an engine. 3 to 4 weeks is about right allowing for time to order and receive the parts etc. No one in their right mind should expect a new truck out of this - a part failed and the engine was damaged. Parts do fail, it was just this guys bad luck that he got the engine with the bad bearing. I have not heard of others seeing this same issue so generally the quality is quite high. I don't agree with the person that said Toyota quality has declined - that simply has not been shown to be the case at all.

I also own a Porsche and I can tell you that they had a serious bearing fail issue with a lot of people's engines having catastrophic failures and Porsche was not fixing those for free. Most had to shell out $12K to $15K or more to fix their relatively new engines. Porsche would not issue a recall. Toyota has been very fair in this case by comparison. The OP should calm down before he pisses off the dealer and they rush his job out.

Didn't Porsche have to settle a class action suit for the IMS Bearing failure?

Toyota does not provide crate motors. They do rebuilds which are just as good. Toyota is the one manufacturer that does not sell a crate motor as far as I know. Besides, a new crate motor would not have any better chance of another bearing failure than a rebuilt motor. You can't tell if the bearing is going to fail until you run the engine. This was a fluke - the bearings are good for everyone else. The engine will be brand new. All of the original parts that did not fail are still new as are all of the replacement parts. You can't demand something that the manufacturer does not provide.

I think they did but I know a lot of people have had to cover the costs of the failure themselves. Could be those that had the failure after the suit was settled - not sure of the details around that. There were a lot of heated people over that issue. Porsche looked pretty bad as a result of their handling of the issue. Didn't hurt sales one bit though.
