So update: I call Mapfre Stadium, they redirect me to Ohio State Fairgrounds because it's technically their property that tell me I have to go through Ohio Court of Claims which cost money to apply for a case or whatever and that Ohio Court of Claims will tell me to go through my insurance. Like c'mon. F**k the system!

Our local NBC station has a consumer hotline. They seem to love 'exposing' consumers problems like these. Possible option to see if your local station does the same???

The news doesn't care about some guy that cut a tire in a grass lot after accept a ticket from the dude at the front that likely had a liability waiver printed on the back. OP needs to accept that shit happens and pony up $150 for a new tire, and this time think about road hazard insurance.

Any pictures of this stake? Might be helpful if news media is contacted.

So it's $25 bucks to file a claim. My insurance will be notified but nothing against me since I'm not filing with them. I'm going to wait and file after I purchase the tire, have it mounted and balanced so I can get all of that reimbursed instead of just the tire. I have witnesses to it happening as well. I doubt I'll lose.
EDIT: I'll get reimbursed the application fee too if I win. That'd be a nice check to receive in the mail later.

Nah. I'll call the police and get the name of the officer that witnessed what happened and his info and include it on the claim. I can do most of this on my own time. I just got back from a long weekend and don't have the time to take. It's not that much really. I have an extra vehicle and family that can go when I drop off my truck to get the new tire.

uh, yeah. cops can't email a report, or maybe they can scan it and send as a pdf instead of fax. depends
on what the police dept has for machines.

just remember...--->>>PAPER<<<--- when dealing with courts and police...

The ROTR website said $20 prepaid parking, $25 day of the show. If you paid for parking, you may have a claim as they offered a service for a fee. However, the back of the parking receipt may exclude the company from any vehicle damage that occurs on the property. This would include fire, theft, vandalism or other damages to the vehicle. My guess is that they covered themselves every way possible b/c that's what businesses do. That said, the stake in the ground is dangerous, but could be classified as an unknown hazard for which they would not be responsible, kind of like hitting a pothole on a dark rainy night, blowing a tire or busting a rim. The state is not at fault b/c you voluntarily went to the concert venue and parked on an at-will basis. Personally, I would let it go, learn from it and move on. And I feel bad for you. It all kinda sucks.

There is a statement like that on the parking receipt. Just like you said actually. But anyone can write anything they want into a contract like that. Frequently courts will still side with the claimant if its reasonable and there's no reason for a jagged piece of sharp metal to be sticking out of the ground where people are parking and walking.

right. that chickeneck sticking out of the ground is unreasonable and could easily be predicted to be a hazard

unlike a tree falling, or some other random unforeseen thing. the day that sign went down
someone responsible knew it became a hazard and failed to act. OP should seek remedy.

You're exactly right. Even if you signed a waiver, they can and will lose in court, I have seen it happen more than once.

I fully agree with your statement, especially since there is no reason for the metal to be there. To save you the hassle and the fight, I would toss in a few bucks into a "Go Fund Me" account to help with the new tire. It would be my pleasure to help a fellow member.
