    Seeking advice, the dealership had been holding my Taco 2016 hostage for 22 days now due to rear axle recall and I was given a loaner, question, do I have the right to request to change my Taco for new truck, thanks !!!

    Looks like they are on a time clock as far as time goes, not sure if a loaner negates that part, I'd drive the loaner hard and put it away wet that is for sure......nothing that causes actual damage but I'd explore it's WOT potential a lot more than my own truck ;-).

    Reasonable Repair Attempts
    You must allow the dealer or manufacturer to make a "reasonable" number of attempts to fix a substantial problem before your car is considered to be a lemon. Usually, you must meet one of the following standards to be protected under your state's lemon law:

    • If the defect is a serious safety defect (for example, involving brakes or steering), it must remain unfixed after one repair attempt.
    • If the defect is not a serious safety defect, it must remain unfixed after three or four repair attempts (the number varies by state).
    • If the vehicle is in the shop a certain number of days (usually 30 days in a one-year period) to fix one or more substantial warranty defects, it may fit the definition of a lemon.

    Getting a Refund or Replacement Car
    If your car meets the lemon law requirements for your state, you have the right to obtain a refund or replacement car from the manufacturer. Although the process for getting this relief is different in each state, in all states you must first notify the manufacturer of the defect. If you're not offered a satisfactory settlement, most states require you to go to arbitration before going to court.

    my biggest disappointed is having my truck seized for so long and Toyota not being able to find a solution within a reasonable amount of time. I wish I could force them to replace my truck since they gave me no option when they decided to take it away in the first place, but I guess it is what it is..... I just have to wait

    I don't know all I know is that I took my truck in for a recall check up and I haven't seen it every since, I have a loaner but this process sucks !!! I never dealt with a recall before

    What do you have as a loaner?
    Are you making payments on your truck?
    If I was making payments on a Tacoma and got a corolla or prius as a loaner, I would be calling someone at corporate for some compensation.
    Thats like paying for a steak and getting a ham sandwich, I would not be happy.
    As far as swapping trucks, not likely, unless lemon law could apply, but that is a question for a lawyer.

    Agree 100%, I make my truck payments if I am driving something comparable. Yota makes my payment if they can not provide me with something comparable. If my truck were to be held for 30 days, I would check on state lemon laws.

    They gave me a Hyundai first and then switch to a Ford 150 3 days ago on my request, the pick up has Target Rentals labels all over the truck because that's all they had available as a pick up loaner, I'm going on 25 days without my truck I guess my questions is , what happens after the 30-day waiting period , can the dealer just keep your truck for any amount of time as long as they tell you that they are working on the recall issue or waiting for ordered parts, etc ?

    It's not there property, they can't impound your truck. Call the cops and tell them the dealership is holding your truck on behalf Toyota Corporate. You'll see your truck pulled up outside.

    I WONDER, IF THEY KEEP YOUR TRUCK FOR MORE THAN 30 DAYS WITHOUT BEING ABLE TO REPAIR IT DUE TO RECALL , THEN IT MIGHT FALL UNDER THE "LEMON LAW" REQUIREMENTS ,

    I am certainly not looking for a recall, I just want some common sense applied by the dealers when it comes to handling the problem.

    Like I said before Toyota seized my truck on May 6 and they still can tell me when will I get it back. What happens after my truck reaches 30 days in out of service status, do I have grounds to request a new truck replacement ? This sucks !

    Wow. Just checked my 2017 Sport that IS included, no leaks, but, the nuts were definitely not tight. Torqued to 18ft lbs and they turned a bit. No wonder they start seeping after a while. Hope I am good to go.

    It's not the dealers fault. They have to follow toyotas guidelines. If not when they get an audit, Toyota can fine them and charge them for doing repairs outside of their protocol.

    Example: You bring truck in for oil change. They see that your vin has an open saftey recall. They inspect the diff and see it leaking. Tech decides to change the gasket. That's not the "proper approval for the repair. Even though if your truck isn't on the recall that's what they would do. Now let's say not only are they billing the gasket and labor out, but let's say the snapped a few studs in the process. That's more parts and labor they have to bill out. Or even better yet the tech wants to make some hours, and decides to just order a new diff. Thy may be able to word it to get it approved for warranty, however when Toyota does a warranty audit they will catch this stuff. So all the stuff they find outside of their approved guidelines they can charge back the to the dealer. This is why dealers now instead of throwing lots of parts at vehicles, wait for guidance and approvals from the manufacturer.

    Off-roads aren't part of the recall. But they will repair your diff that same day as long as parts are available
