Inspection was done in about 20min. All nuts already at 33ft-lbs. They said they would open a report with "California". I assume that is Toyota Corp.

Has someone had their truck held by the dealer longer than 37 days straight ? Just out of curiosity, and can you file a lawsuit against them for keeping your vehicle that long even though they provided you with a loaner, based on the aforementioned, can you ask them to replace your vehicle for a new one , seeking feedback , thanks !

Best bet is to use the yellow pages and find a lawyer who does that kind of stuff.

I imagine they'll tell up front what your options are.

That's all well and good. But my 2016 Taco just celebrated its 30 day Anniversary in the shop for the diff leak. Toyota Corp. received my "Notice of Defect" via registered mail 2 days ago. Per Florida law Toyota must refund my purchase or replace my vehicle, prorated based on mileage. In Florida 30 days in the shop triggers the Lemon Law.

I just passé 30 days in the shop for the same thing. Toyota does not have a solution yet. I invoked Florida's Lemon Law. Toyota must now refund or replace my Taco (prorated adjustment based on mileage)

I think the question is, has anyone gotten their truck serviced for a rear diff. that was leaking and gotten it back?

My went in today. I was told a month.

So after hitting 30 days of my truck sitting at the dealership, and after many calls to Toyota to push for a fix, I said f#%k it and called the dealer and told them to check torque on bolts and top the oil level off. So when I arrived to pick it up, the manager had no issues with complying with my request. He did say it took almost a quart of oil and they found 3 bolts were not torqued. As a mechanic myself some of you are probably going to ask why risk it?? Well, when I got home I cleaned up the differential and double checked the oil level and visually the insided showed no signs of damage. After two weeks, 500 miles later, no signs of any new leaks and level has not dropped any.... so can they keep your truck??? Id say no since legally you own it but if your comfortable taking the mater into your own hands then take it back because you won't be getting it back anytime soon. As for warranty, dealer will still fix my truck once they have the parts kits.

If they are on the recall list = No

If not on the list = Some told normal no problem, some were re-tightened and sent on their way, some were held after calling corporate. And some were fixed under warranty

Mine is being fixed currently. It's not on the list. They are changing the gasket and the bolts. They said it will take two hours. We will see.

Took mine to the dealer yesterday for 20K service. It was not leaking. So they tighten and sent me on my way. They mentioned that if I was leaking, they would have to put me in a loaner and hold it.

Mine wasn't held (not on recall) but they agreed it needed to be fixed. They ordered the gasket and checked the fluid levels and sent me on my way. Got a call last night that the gasket was in and they scheduled an appointment with me on Wednesday next week to replace it. I will be making sure they clean the diff off as well, and then keeping an eye on it to make sure that actually fixed the problem.
