    As a teenager a few of us did this to replace a buddies flat tire...I have felt terrible about it since. I'm not proud of it at all.

    You can citizen's arrest someone if you witness them committing a felony. Stealing personal property is a felony. You can detain them. I remember this because of a private security class I took in college. I can't remember what you are supposed to do when you 'detain' them other than to tell them that you are conducting a citizen's arrest. Not sure if you can use cuffs and shit. I'm am 99% you can't use deadly force to do so (so using a gun to get them to sit still is probably off the table).

    Via the all knowing Wikipedia:
    837. A private person may arrest another:

    1. For a public offense committed or attempted in his/her presence.
    2. When the person arrested has committed a felony, although not in his or her presence.
    3. When a felony has been in fact committed, and he or she has reasonable cause for believing the person arrested to have committed it.

    Whose? OP's damage from their thievery or the tire that got shot to strand their ass til popo got there. Maybe they stuck the wheel on their truck and the one that got shot was the one they stole, lol. Like to see them claim that. Guess they could claim some gangstas made them come steal shit for initiation too.....and get a pass right?

    True - I know you're talking about the guy in his past. I'm thinking these guys were after a KO2 which most people don't get for their spare - other than that if you're not a picky thief go for the spare... Since I have a nice spare General Grabber I'm thinking of welding a bolt onto the spare tire carrier under the bed and putting a locking lug nut on it. Even though you can defeat the locks you have to be packing the right tools.

    Basically it says Under this doctrine, a person has no “duty to retreat” before resorting to the use of deadly force when faced with imminent peril in his or her home.

    Also in Colorado, and many other states, it is extended to your vehicle so I can have a concealed hand gun in my truck. The hunting laws do come into play where you can not have a "loaded" rifle or shotgun.

    The word "allowed" really bothers me (Unless you're a convicted felon or something like that) because the Constitution grants you that right. My state is slowly moving left too. Same people that got elected to pass the recreational marijuana laws, are also the same people that don't like guns, rights, and freedom.

    Thanks, I'm still using the spare, I highly doubt my wheel and tire will ever be found. I may have over simplified what I thought happened here in Colorado. Amendments are voted for by the people, like 64. The elected officials who had the majority of the General Assembly passed CRS §§ 18-12-302, 18-12-303 restricting magazine capacity. Yes that is a law, and the General Assembly did pass it. I feel those two things are linked together. Liberal Peeps move to Colorado, those peeps vote for 64, and elect politicians that ban high cap mags.
