Frame Rust 2005-2008, Settlement was reached. I've read it. Does anyone know how to get our new frames now? My dealership doesn't know a thing when I call them. I actually forwarded them the court papers. Has anyone gotten a frame yet on the settlement?

I'm on the same boat as you bud. My local dealer has been stalling me for months saying that Toyota hasn't given a green light yet.

It is true (per a friend at the local dealership). Toyota has not as yet provided the dealers with any procedural guidance or even any official notification of the settlement.

The feeling there is it will be mid-July/August before they are advised as to how to proceed. Billing codes are the most important thing, they will not do squat until they're sure they will be paid for it.

The court order was finalized on May 21st. The dealership couldn't do anything till now. I was just wondering if anyone had heard. My dealership called me like 5 minutes ago indicating that the frame is a definite and they'd proceed once Toyota gives them direction. Hopefully we'll get some word in the next couple weeks.

Per the Frame Rust Settlement Website:
"In June, 2017, appeals were filed to the settlement. This will delay implementation of the settlement."

So if you bought after 12/2/16, are you covered or not?

I just bought my 2005 a few weeks ago, and it had the frame replaced early this year. It's damn near a new truck under there now.

Same here. I was about to purchase one hoping to get a frame replacement, but then read the settlement and realized I wouldn't be part of the class so searched hi and low until I found a 2006 with a new frame.

I would recommend anyone looking to buy a 2nd gen Tacoma in the NE to only look for new framed ones.

I guess there is a silver lining... and i mean this as no disrespect to those with rusty frames who may not get new ones.

As someone stated in another thread on this subject, this frame issue and the now delayed settlement, could hurt the resale value of the 2nd gen Tacoma. But those with a 2nd gen and a new frame will be unicorns at a certain point (probably around 2022 or 2023 when the 12 years is up for 2010 trucks) and would probably have a highly inflated resale as we see with the 1st gen.

I don't wish for this as I would rather all my Tacoma brothers and sisters have rock solid trucks with brand spankin' new frames, but it could be the reality.

I recommend that everyone read the settlement. I am certain I am getting a new frame. My dealership is already compiling a list of eligible people. It's simple. If your truck meets the criteria, within the settlement dates from before and needs a frame, you're getting a frame. Mine was inspected and it is documented. It's not all doom and gloom. My frame has a hole. I'm not loosing any sleep over it, because I read the derned papers. It's simply a matter of when. All of the people filing "appeals" right now are simply trying to get paid for their previous expenses. Many of them no longer even own the trucks. Some never owned one. Yes, read it. So, once that formality is out of the way, new frames will rain from heaven. If you didn't research the issue, and bought a rusty frame after the settlement, well... I'm sorry, but in my understanding of the law, you are not covered. You may wish to explore other avenues to fix the vehicle.

Regardless of fake news, the official Federal Court document says we get new frames. I will keep everyone in the loop as I go through this. I will have a new frame soon enough. In the very worst case scenario, even if something came up to exclude me, I'd do the frame myself. I have the tools, and at least I'd know it was done right. However, I am certain after reading the entire court document, and I work in the courts, that this is binding, and whomever needs a frame within the criteria specified, gets a frame. I like my truck. I loathe new truck payments. Keeping my truck.

So here's an area beyond my expertise. I was told that my truck should remain there for safety reasons. Potentially, that's a $4500 dollar rental bill. According to the Final Order, Toyota is only obligated to 7 days of rental reembursement, except under "exceptional circumstances". Does anyone know anything about that? Is an unsafe to drive rating considered exceptional circumstances?

I have been told the Toyota pays for the rental no matter how long it takes.
