    Have any of you who have had your Tacoma impounded for 2 months or more at the dealer consider asking Toyota to extend your basic warranty to cover the additional time it was just sitting? Seems like a reasonable request to me.

    Seems to me this problem will be on going. Changing gaskets and bolts which they do not have is like putting a band aid on the problem.

    That is why the fix includes new studs and to torque down to 28 foot pounds, basically a thicker gasket and tighter torque for uneven carrier and axle surfaces.

    Everyone should write bad yelp reviews and then they will take notice. No business wants a bad reviews. And then dealerships will put pressure on toyota

    I just finished coming back from my dealership I went over there to put some stable in my gas tank as one of the guys from this form recommended that was a great recommendation whoever that was. Also while I was there I took advantage and counted more or less how many trucks are there including mine and right about now from the ones that I could see not driving the whole dealership there was 10 right around my truck that we're still waiting for parts. It ain't for nothing but I was actually thinking about calling my local news and seen about what they can do as far as getting answer from the Toyota Corporation Toyota is not trying to be in the spotlight for this recall or for as long as it's taking so any publicity they wouldn't like.

    I have a TRD Off-Road, and wasn't really too concerned about this since I wasn't part of this recall. But wouldn't you know it I was bored are read through a bit of this thread....then I was like "man....maybe I should crawl under mine and check out the situation...."

    Sure enough I have two small spots on both the driver and passenger side of the diff (total of 4 spots) that are weeping.... great... I'm not even sure what to do with this at this point, since it isn't part of the recall. I guess I will take it to the dealer this coming week and at least get it documented since it doesn't sound like they are doing jack shit for Off-Roads....

    It never ends with this truck...

    Take it to the dealer and they will either fix it under warranty at the moment or retorque and send you on your way. If they retorque and or send your way at least it is documented. From what I can tell there are a lot of trucks not on the recall that are weeping. I am thinking the 228k were just the beginning of this fiasco. GLWYT

    I think it is helpful to reply to this as it also can give insight to other states. As I have noted before, Lemon laws were not intended to cover recalls and it would take a very good lawyer and the right judge to have them apply. However, even assuming that the Louisiana law DOES cover recalls, the law has some fairly serious limitations well beyond most. As many others do it requires that the customer be the one to inform the manufacturer about the problem, not the manufacturer informing the customer. Unlike most that I have seen it expressly requires that the consumer comply with any dispute resolution procedure in the purchase agreement (its in your contract, read it) before applying for a lemon law relief. Also unlike most, Louisiana has an unusual limitation that it must be within 1 year from purchase regardless of whether it was under a longer warranty. Most states cover the entire warranty period. Again, all of these stipulations point to the fact that the law was not intended to cover recalls (recalls, especially for safety, are never time limited or limited by warranty coverage). This this does not necessarily mean that the right lawyer in the right courtroom might not be able to get you some relief (or negotiate something with Toyota), so please consult a lawyer, but don't expect Lemon Laws to automatically apply to a recall. In my fairly extensive internet searches I have yet to find a case where a recall was covered under a lemon law UNLESS the fix applied in the recall did not work, resulting in multiple unsuccessful attempts to fix. I understand everyone frustrations (including mine), but people need to be realistic.

    A couple of observations:

    1.If anyone still thinks they they might be covered by a lemon law in a particular state you cannot just read an internet paragraph summary of the law, you need to read the entire text of the law and then consult a lawyer with lemon law expertise to determine how it applies. Most of the summaries omit key details.
    2.IMO Toyota is opening themselves up for future lemon law cases due to the shoddy quick and dirty attempts that some seem to be seeing. It appears that a few people are seeing leaks after the re-torquing. If people start seeing leaks after fix attempts then use of lemon laws start to look more viable. My service department has over 50 trucks waiting fixes and apparently Toyota wants them out the door within a day of when the parts come in (they are not sent in bulk but by individual parts order per truck). This seems to be asking for trouble if they are rushing the dealers.
    3. I personally have serious concerns regarding the long term viability of the fix they have identified. It depends on the variability of the gaps they are trying to cover with the gasket and the materials used. The over-torquing tells me that they are using a thicker gasket to fill in some fairly large gaps with a fairly pliable material to fill in those gaps, much different that what a gasket has to do when mating even surfaces. I wonder if the specifics of the surface variability and the gasket design will be available. Obviously a more elegant (and expensive) fix would be to replace the housing with correctly manufactured surfaces, but of course Toyota would prefer not to have to do that. I hope that I am worrying about nothing, but....
