New nj motor vehicle law

Money making scheme and a law nobody ever heard of. Got this in a email. Is it true ?
New Law: If a patrol car is pulled over to the side of the road, you must change to the next lane (away from the stopped vehicle) or slow down by 20 mph. Every state except Hawaii and Mary land and D.C. has adopted this law now.

A friend's son got a ticket for this recently. A police car (turned out it was 2 police cars) was on the side of the road giving a ticket to someone else. He slowed down to pass but did not move into the other lane. The second police car immediately pulled him over and gave him a ticket. He had never heard of the law.

It is a fairly new law that states if any emergency vehicle is on the side of the road, if you are able, you are to move into the far lane. The cost of the ticket was $754, with 3 points on your license and a mandatory court appearance.

Please tell everyone you know about this new law.

 

i noticed people do that a lot in Tennessee....but not so much here in WA state.

 

That's a law in Ga. Been that way for a year or so.

 

eh its kind of a common courtesy to move over. i move over anyways regardless of a law if theres a cop on the side of the road, somebody broke down or changing a tire, bicyclers, walkers, geese, or anything else i dont want to crush the guts out of

§ 46.2-921.1.
Drivers to yield right-of-way or reduce speed when approaching stationary emergency vehicles on highways; penalties.

The driver of any motor vehicle, upon approaching a stationary emergency vehicle, as defined in § 46.2-920, that is displaying a flashing, blinking, or alternating emergency light or lights as provided in §§ 46.2-1022, 46.2-1023, and 46.2-1024, shall (i) on a highway having at least four lanes, at least two of which are intended for traffic proceeding as the approaching vehicle, proceed with caution and, if reasonable, with due regard for safety and traffic conditions, yield the right-of-way by making a lane change into a lane not adjacent to the stationary emergency vehicle or (ii) if changing lanes would be unreasonable or unsafe, proceed with due caution and maintain a safe speed for highway conditions.

Violation of any provision of this section shall constitute a Class 1 misdemeanor. If the violation resulted in damage to property of another person, the court may, in addition, order the suspension of the driver's privilege to operate a motor vehicle for not more than one year. If the violation resulted in injury to another person, the court may, in addition to any other penalty imposed, order the suspension of the driver's privilege to operate a motor vehicle for not more than two years. If the violation resulted in the death of another person, the court may, in addition to any other penalty imposed, order the suspension of the driver's privilege to operate a motor vehicle for two years.


Class 1 Misdemeanor -- Either or Both -- Jail, No more than 12 months / Fine no more than 2500.00

 

I always thought that was a law.

Don't get me started on NJ. I just dealt with NJ DMV yesterday, had to pay a $100 license restoration fee to them in order to renew my SC license. The funny thing about that is, I've had a valid license in SC for a decade so I paid a restoration fee for a license that doesn't exist.

My hatred for NJ knows no bounds.

 

X2. people here in WA tend not to do too much when they see emergency lights. At least in Hawaii, where I grew up (and apparently there is no such law) people slow down and pull over

 

the law makes sense, and i always move over for any vehicle on the side of the road just for safety....i was talking to an officer in florida though (where i go the school) and he let me in on the bull shit side of it. he said sometimes they will pull someone over for a legit reason (speeding, etc.) and while the officer who pulled the initial car over wrights up the citation, 2 more police cruisers will pull up behind the first officer. he said the other cruisers will then jsut wait for someone to break that law and pull them over...and the cycle repeats. he said the'll just "leapfrog" like that for about 10 miles down the road, and that it's a good way to guarentee the writing of tickets for a whole night.

i am all for safety and the use/inforcement of laws that help the cause, but it pisses me off when officers take advantage of them...especially when i hear abotu it first hand from an officer

 

Wow! My question is why doesn't it apply to break downs as well? seems we make more laws to protect civil servants, than for the people.
And $750 for the ticket is ridiculous!

 

I wish SC had that law.

 

I'm not sure about FL laws, but if that is what they have to do to enforce the law then so be it. (of course i am biased)

Per our state laws all i have to be is stationary on the side of the road with my lights on, i don't have to be stopping anyone. So i could get people on my own without the extra cars, hmmm...might have to keep that in my back pocket for a slow day

But in all seriousness, you should move over, ALOT of emergency workers get hit on the side of the road trying to assist other people. Its so bad that the new ford police interceptor can withstand a 75mph rear end collision since people rearending stopped police cars is such a problem.

 

yeah, makes no sense, you'd think it would have been easy to make the law and vehicle with hazard lights on....oh well

 

Same here in Utah.

 

I always do...and so should everyone else. Not only is it common courtesy, but if they step back or trip and you hit them...that'll be involuntary manslaughter or vehicular homocide (depending on circumstances) if you kill them.

 

how often do u pay attention to a car broke down on the side of the road???? now, how often do u pay attention to a cop car, fire truck ambulance etc... with lights on. if we had to pull over for every car on the side of the road broke down. they would have to just lower the speed limit way down cuz there is wayyyyy too many cars and they dont pull off the road far enough at all. i can speak from experience of stepping out of a firetruck on the side of the interstate and having cars zoom by me at 80mph+ and its scary shit. so if u guys wana complain about cops playing a game and pulling people over for not getting over..... then get over and u wont have to worry about it

 

Explain to me how that is "taking advantage" of anything? The law exists and people break it- The "extra" cops just so happen to be there for the specific purpose of enforcing it.

If the people driving obeyed the law-The "extra" cops would have nothing to do.

And now you are thinking about how they might be there waiting for you- So I bet you'll move over....

 

It's the law here in MN too. Passed a couple years ago.

I have noticed that the highway patrol now walks over to the passenger side of the car when approaching a vehicle they have pulled over. Makes sense for them if the car has power windows but if it doesn't?
