    Been on vacation for 2.5 weeks and have not been on here. Came back today for updates and looks like we are still in the waiting game. I think I'll have better luck scraping the surface rust off, and coating it myself...

    Here's what I have found:

    There have been ten appeals filed; nine by plaintiffs, one by the defendant;

    This is the latest published docket for the case (note the scheduled dates):

    In summary:

    Dates:
    06/30/2017: Mediation Questionnaires due;
    07/19/2017: Transcripts due to be ordered;
    10/17/2017: Transcripts due;
    11/27/2017: Appellant Cemil Hope opening brief due;
    12/27/2017: Appellees Ryan Burns, Dale Franquet, James Fuller, Jame Good, Kenneth McLeod, Michael Meade
    Toyota USA, Brain Warner and Michael Watson answering briefs due;

    Appellant's optional reply briefs are due 21 days after service of answering brief--i.e. 01/17/2018 at best¹;

    After that there will likely need to be perhaps a renegotiation of the settlement agreement, another subsequent preliminary approval, and yet another round of all the notices, fairness hearing(s), etc. before a new final approval and order are entered. This could easily go on 'til next spring...

    ¹ - However let's say one appellant is not served until 01/03/2018, then it becomes 01/24/2018 before anything else will happen.

    Toyota dealers have at best only a loose affiliation with with Toyota Motor Cars, but beyond that their primary business is glad-handing¹. They will say whatever they believe will, at this specific point in time, be what the customer wants to hear. If you want a blue car they will turn on a blue light.

    Their telling you "we'll know something in a week or two" for six weeks means they don't have a clue.

    As to the lawsuit I had been going along with a December guesstimate another poster had put forth, but after reading the docket schedule my friend uncovered this morning I'm moving toward thinking March maybe; April or May more likely, June most likely. You have to remember that none of the on-stage players--the judges and certainly not the lawyers who bill by the hour, or the appellants who are all after their own interests--give a rat's back-end about the "class" members, the poor guy with his frame rusted so badly he can no longer drive his truck.

    Huh... I wonder is this was a document prepared in advance of the appeals being filed?

    Or it could be that Toyota's "appeal" that was filed was a "throwing in the towel, let's get this ball rolling" thing.

    A company I worked for year ago had reached a settlement with the AFL-CIO, after which appeals were filed. A few months later they won some large defense contracts and notified the court they were going to concede on all points; essentially ending the suit...

    I complained to Toyota and To a service manager about how this process has me stuck in limbo. (Truck getting worse everyday but also can't fix it on my own because I know this lawsuit was going to go through and also couldn't sell it because the frame was so bad) a few minutes later I got this 5 page memo from a service manager. Took my truck in this morning, got the inspection and got the parts ordered.
