I have not read the waiver to know what is being waived--however I suspect your signing it would put you in a worse position as they would then have your acceptance of liability in writing, as opposed to their having only an undocumented assertion...

She was clear - no signature = we cannot release it back to you. I've read the same thing
you've said by many here and if push came to shove, I'd go batshit in there and this is the
easy way :D for everyone involved. I have yet to read it, still waiting on a call on the appointment
    date to be confirmed.

Sounds like they need to hire a special "Recall TSAR" to take control of this situation.

All I have ever said re: this is that "they have no legal authority" to take your vehicle. "She" can tell your they "cannot release" the vehicle 'til she turns green, BUT they have no legal basis on which to confiscate your property.

At that point (would I not to go batshit, and ask "Just exactly what are you planning to do to stop me from regaining possession of MY truck?") I would ask them to sign an agreement defining their liability for any loss or depreciated value resulting from their extended--for some unspecified period of time--illegal seizure of your personal property.

Ask for a copy of their insurance policy that covers vehicles being illegally held, and that they provide an insurance binder specifically covering your vehicle.

Tell them you intend to suspend your liability, collision and casualty insurance while the truck is in their possession--no reason for you to pay for it as you will not be driving it, or have any control over who might and whatever sort damage they might cause.

Their is no way if it were me that I would just smile sweetly, say OK, and walk away accepting Toyota's BS. This is a giant clusterfuck for Toyota, they need to start realizing that because based on some of the reported conversations people have had with Toyota's "customer service" they don't seem to get it yet. It is largely irrelevant for me to say this, as I will likely never buy another new car anyway (truth be told I prefer "used and proven"¹), however I would definately not but a new Tacoma after this fiasco and probably not ever any Toyota...

    ------------------------------------
¹ - I have found "used and proven" to be the best way to get wives too. My first was brand-shiny-new and though it lasted 21 years the last 5 or 6 were a bitch (literally). Second time I got a used one--it will be 26 years in April and she is still my BFF.

OK so they had my truck for 75 days.

SO FAR I have not heard of a truck being held more than 100 days. Correct me if I'm wrong.

So AT LEAST at this point you can probably expect no more than 100 days.

Now that I have my truck back, it's been great, but yeah it was really frustrating when they had it. Zero communication on their part. It would have been a lot better if they had just communicated with me every few weeks or so. I always had to do the calling.

Sounds like your getting a good deal. They didn't ask to impound your truck....ordered parts and you keep driving it. Hell...I"m fighting with my dealer to even recognize that its leaking. It will take them a day to get the gasket installed and you'll be good to go. Am I missing something?

We waited 11 weeks for a carport that was supposed to be erected in 3 to 4--same thing I had to call, only to be told every conceivable excuse you could imagine. I was fortunate that we had put the deposit on our VISA card, I called VISA at about 9½ weeks (after not hearing from the carport place for 3 or 4) and started the process to dispute/cancel the charge--low and behold the carport people called 4 days later and set up a firm installation date.

Their salesperson called a week or so later to "make sure we were happy", I told him "happy" was off the table after their fundamentally telling us "We don't give a shit." for over two months.

In the end we got a nice carport (20' x 24'), but it was a PITA getting there:

I really don't like being a prick--which is kind of surprising as I generally like to do things I'm good at--but every now and then it's the only way to get things done...

I wonder if someone could order the parts from one of the Toyota Authorized parts dealers and get them sooner, show up to the dealer and say here is the f!@#$% parts fix my truck!!!

I really don't believe their is a parts shortage, just Toyota slowly releasing them at a time.

One thing as well, for those who got yor trucks back within a reasonable amount of time less than 30 days. Were the dealerships sole Toyota Dealers or Mega dealer plexs with many brand names under the roof. My guess would be individual Toyota dealers would have better service than the Megacluster dealers.

I had thought about that, there are a bunch on online OEM parts places listing the "new" gasket p/n, some saying "in stock ships in 24 hours"...

Yes you can. It was discussed and one member did it showed his dealer the invoice from the other dealer and was reimbursed for the parts. It was a bunch of pagesbback in this thread.

If you want them to call you first thing in the morning email this guy. jim_lentz@toyota.com Every time I've sent him one I get a call first thing from one of these sunshine blowers. Just keep doing it. Also, keep up the bad PR on the Toyota USA facebook page. They don't like anything negative on there.

Smart move. Also just pay the minimum monthly payment until the product is delivered. You pay a little extra in credit card interest but you have some leverage if needed with most of the balance being carried by the bank.

I got an update from my SA today and it seems like the same as everyone else. Almost like it's scripted. He said "I checked on parts for your vehicle this morning. I am waiting on one more part to come in. I am hoping with in a few days . I should have all parts." Why is there always 1 elusive part holding everything up?
