Does This Differential repair done at Toyota done right? It was on recall!

    How can the dealership be committing fraud If the repair is an acceptable industry safe application??

    And all repairs done at the dealership are warranted as far as I know or otherwise stated in writing to the customer.

    The only thing they are guilty of is repairing it in an alternate but industry acceptable manner, trying to get the customer out the door faster, and saving the factory additional rental costs.

    This is also why they should have made a gasket lol!

    I hope other dealers see this thread and either park the vehicles and wait for a gasket for however long it takes from TOYOTA to arrive or simply just make one, very easy fix.

    I work at a dealership (Not Toyota) and it sounds like they got you going after a rental truck was not available, not your fault for not wanting a corolla as you bought a truck to use for daily work. The only shady part is them telling you that the RTV is a fix for the recall, what they should of done is tell you "Listen, we used RTV to get you going with your truck again while the recall parts are on order, soon as we have yours in we'll give you a call".

    If the diff were to ever fail and OP brings his truck in, the dealership marked the service as replaced with the proper gasket. They take the diff apart, RTV is there instead of a gasket and they'll happily tell you you're SOL since they have no record of using RTV on your vehicle. While the RTV would more then hold up, for warranty purposes he definitely went the proper route bringing this up to Toyota in case anything were to ever happen. Nothing wrong with covering your own ass, especially when you just dropped a good chunk of change on a brand new vehicle.

    I would rather have an RTV gasket than a paper gasket. Just because paper is what comes from the factory doesn't mean it's the best option, as shown by the 200k+ truck recall for leaking diffs.

    That looks like a pretty clean job. It's completely normal to have some of the gasket come out the sides like that, as long as it's not oozing huge chunks.

    If anything I would have the dealer fix the documentation so it specifies they used RTV so you have that if it ever comes into question at a later date.

    so you rush them to do the recall...and you are concerned that the thickness of the rtv is going to throw off your drive shaft angles....i wish i had those problems

    tbh id rather have rtv than the gasket they used on the third. I run the black stuff and it has never failed me.

    I think maybe they were saying fraud because his receipt listed the part that was not used, but who knows.

    I said fraud because it technically is fraud. It doesn't matter that the fix completed was industry acceptable. All dealerships were given explicit instructions with a parts list for this recall from Corporate. This dealership performed an alternative fix, yet failed to properly document said alternative fix; all the while generating a work order for the instructed parts list on the recall with intent to file a warranty reimbursement claim. The side effect of this action throws the OP's warranty coverage on that piece of his vehicle in jeopardy.

    All this shop had to do was what post #103 suggested and this would all be a non-issue.

    If it (Permatex) can be bought at the dealership or distributed and used there as a gasket, there's no fraud, it will seal if properly applied.

    The only one that would be in jeopardy would be the dealership who perform the repair same as they always are responsible on any authorized repair.
    The OP is covered, he took it in good faith to fulfill the recall, they repaired it and what motive would he possibly have in applying his own RTV?? Any attorney would have a field day with both entities, if they ever tried to deny him and they know it. Not gonna gonna happen they would do whatever it would take to it all straight.

    Now he just needs to sleep tight

    hey, we all bought expensive trucks . I bought a new 2004 trd and it had a recall for an undercoating to prevent frame rusting out and they had it for a week and gave me a Yaris as a loaner so I said F-it road trip time on Toyota corp. God closes a door but opens a window.

    Update, Service manager called. He said they believe the repair is done (better per industry standards) than what Toyota gave directions to fixing. I'm not a mechanic and have no idea what is better. He stated that he would redo repair if that is what I wanted. I told him if he was willing to put in writing that this is there work and does not impede my warranty, I would not mind the repair as done. He said he did not like that idea (putting anything in writing) and had rather fix it Toyota's way. So we agreed on it being done next week. I then called John (case guy from toyota) to tell him what had transpired and to thank him. Before getting off the phone I asked about the others that were fixed like mine at the same dealer. He stated that unless they called Toyota with this concern they were basically on their own. So there you have it.

    The dealership basically committing fraud on the truck's warranty service documentation to Corporate, saying they performed the recall to spec.

    That would tick me off... that's a crock of poo there. For all the posts, this point is major as the dealership said they did it right, but it was not. All the documentation that Toyota would have seen would have killed any warranty as Toyota would have told the OP he did not replace the "correct" parts on the read diff w/ correct ones after the dealership did it "right". End of story...

    You can argue what's better or worse, but they noted it was fixed using specific parts noted on the dealership paperwork. They did not and that is not even close to legal as they falsified documents especially on a NHTSA recall.

    Really? We're even arguing this??

    Glad to hear. Folks can argue what's better or worse... but if the warranty is involved and this is part of a recall, they should have fixed it per the specification. That is the ONLY acceptable repair per the documents filed w/ the NHTSA for this recall.

    IF.... folks want to go out and do it their way, more power to you and you may be right. But falsifying documents on a recall is a load of crap.

    This might Help the others being repaired by Dave Edwards Toyota in Spartanburg who have repair already in place. That's why I posted update. There are at least 4 or 5 on the road with RTV that may have warranty issue in future. Toyota nor Dave edwards are going to reach out to them. They may be SOL.
