    I've been without my truck since early August. Is there a time frame that lemon law becomes applicable?

    If you complain toyota will cover 60 a day to put you in a truck. I'm paying the 6 a day in tax so it's costing me like $180 a month out of pocket ($1800 to toyota:rofl:) but well worth it to have a truck I can use on the daily. I was hoping not to get stuck with it for over a month but who knows.

    First used Tacoma I can work into a deal on trade I'm off loading this bitch. Completely over this whole stupid mess

    I don't think recalls work like that. But I could be wrong.

    I told toyota to get me a truck and an F150 is what i got. They mentioned the camery to me and I told them sure. Ill load 2 refrigerators and a dress on it, tie it to the roof and be back tomorrow for another loaner. "Get me a damn truck TODAY". That's what they did.

    Any idea where I'd be able to look this up for Missouri? Currently googling feverishly.

    "Additionally, an automobile may be considered a lemon if it is out of service ("by reason of repair of the nonconformity") for 30 or more working days. This does not include routine maintenance, such as oil changes or checkups."

    statelaws.findlaw.com/missouri-law/missouri-lemon-laws.html

    That sound right?

    Interesting you guys were talking about lemons. This is what I found out about TN Lemon Law

    Tennessee Lemon Law Protection
    According to Tennessee, a "lemon" is a motor vehicle that falls into each of these categories:

    • Sold or leased after January 1, 1987.
    • Has a problem that impairs safe use of the vehicle, or reduces resale market value.
    • Can't be repaired (by the dealer or manufacturer) after 3 attempts, or is unable to be used for a cumulative period of 30 days or more while under warranty.

    Got the letter a while back, went out to look and no leaking seen. Made the 5K appt earlier this week then went out and looked at the diff... minor seeping. Very minor. So I took a picture. Took the truck in today and told the SA I got the letter and to please fix the trans gear hunting and plug the LCA's.
    "OK" he says. "I'll need the truck about 4 hours. You need a ride?"
    I said "if you're gonna do the recall then let's get it out of the way and put me in a loaner now".
    He asks if it's leaking.
    I said yes a little.
    So I go wait and about 30 minutes later he finds me and says "walk back to the shop with me". We get back there and walk under the truck, he points to the diff and says "it isn't leaking".
    I give him the extended WTF look and pull out my phone to show him the pic. He looks at the Tech and asks if he cleaned it. Nope with a head shake. So I call bullshit.
    He goes to get the Service Manager who walks under the truck and says "it isn't leaking". I show him the pics.
    They all do the stare at each other "what now" look claiming they didn't clean it. So now I'm the dick. I tell them no chance that fluid vanished on the 10 mile drive in this morning.

    I think they got caught at some sick game. They said they have 38 Tacos out back all waiting for the fix, like it should discourage me from the loaner. But then the SM says they have a Tundra I can drive and if I text him my leaky pics he'll do the recall using them as the basis. So I'm real confused at this point. Anyway, I took the Tundra, they kept the Taco, but I have a bad taste in my mouth.

    Does this warrant a call to Toyota? I mean, they're doing the recall, but it's shady feeling.

    Here's the seeping in my driveway from Wednesday on the left, and on the right the wiped clean edition up on their lift.

    Here's what I would do:
    • FWIW bring the situation to Toyota corporate's attention; while flailing my sword about like Don Quixote attacking a windmill, because that's about what doing this would be worth--but WTF I'd go for it;
    Then,
    • Using a known accurate torque wrench of an appropriate torque range (probably a 3/8" drive wrench) I would make sure the carrier fastening nuts are torqued to 18 lb·ft (do NOT use a 1/2" drive torque wrench as there are none¹ that are sufficiently accurate at 18 lb·ft);

    • Next I would check the axle fluid level and top off if necessary;

    • Then I would monitor the rear-end each day for a couple weeks, then each week for a couple months, then each month for a year (this last only only because I am anal about stuff like that);
    After that I would drive the truck for the next 100k to 150k miles as though none of this ever happened...

    ----------------------------------------------
    ¹ - Actually one could likely special order such a 1/2" drive wrench from Snap-On or one of the other major "pro" tool makers.

    Yea, since they're doing the recall I was thinking of holding off on the call to Toyota until I have my truck back... supposedly in October. And I did get a Tundra from TRAC so I'm not totally out of commission.

    For me it's the principle. Was my leak bad? No chance. Could it worsen? Sure. But if Toyota thought well enough of any seeping to down the truck, and the NHTSA is involved, exactly who in the hell does this dealer to be named later (in PHX) think they are to try and erase the evidence and put my family back on the road in a truck obviously caught up in a safety recall?

    I'm more pissed at this dealer than being out of my truck.
