    My father in law was killed in the same kind of circumstances by a young man trying to get to the mall before the stores closed. He was not found at fault because nobody wanted to be a witness and the police are being instructed to not give any opinions in writing on accident reports because they end up getting called into court as witnesses which takes them off the street. The bad thing for my wife is she never got an apology from the young man because his lawyer said that could be interpreted as an admission of guilt by a jury. Messed up just a little don't you think?

    @ksj I agree with this. I always wait behind the stop line when I am making a left turn and have to yield. Then you are not stuck in the intersection when this situation happens, ripe to get hit (by an idiot trying to beat the light).

    I think you will likely be placed at fault for this. Especially depending on the yellow/red light laws in your state. Some states say you can go through yellow, some say you can't. You were in the intersection after the light turned red. That's pretty cut and dry to me. You TECHNICALLY are not allowed to "start" making a turning movement unless you can fully clear the turn. That means crossing the stop line waiting to make a left half way out in the intersection.

    A dash cam could have actually made your situation worse in this case. If they could see the footage and prove the light was yellow and his relation to the stop bar, you would be screwed. Additionally, it confirms you were in the intersection when the light was red...which is not what they want to see.

    Anyways, I hope you are okay, healing well, and the truck gets sorted! A rare Cavalry blue taco already taken out. A sad sight.

    Oh, yeah. Never trust the police. They're never trying to "help you". Sounds like you did all the right things and lawyered up though.

    Side note - seems all these safety systems can't prevent accidents. Who knew.

    Damn! Really glad you’re ok for the most part. Been through this a month and a half ago with my 2017 pro. I had 2400 miles on mine. It sucks really bad. I was rear ended by a semi that jackknifed on snow, so most of the impact was rear, but we spun around and the trailer caught us again in the front.

    NO AIRBAGS DEPLOYED!

    I thought hmmm? Now I see your crash pics. I asked the body shop guy if that seemed odd, but since mine was mostly rear impact on snow, he wasn’t too surprised. He said it’s about inertia forces. But now I wonder if we’ll see something emerge in the future about these types of no show airbags. Not that airbags are fun to be hit by, but if they are there to save you, You should be able to count on them.
    Oh, and beware at valuation time with insurance! They tried to sneak in a trd sport as a comparable vehicle. It was titled as a TRD Pro, but the amount it sold for sent up red flags to me. I ran a Toyota vin check from their owners portal on this truck, and busted them out, big time.

    At any rate, Good luck! You will get a new pro, and life can start to return to normal(somewhat). This process sucks total balls, and it’s frustrating as hell. The awesome members of TW were here to support me, and we’re here now for you!

    I never meant to insult any one by calling it BS I just don't believe in it myself .Here in Canada its breath teat all the way. If you refuse to do it your under arrest ,cuffed and you will have to blow it at the station anyway. I just think its a superfluous step that some long time drunks that you would never suspect can pass, probably the HGN is harder to fool but if it smells or if you get told some alcohol was injested prior to the check its breth test.

    Its sad the way people drive anymore. To many distractions. To many idiots on the road. My Corolla met a similar fate when a guy hit me just because he could. There is not a week that goes by I don't see some idiot doing something that can cause a wreak. Have not gotten to see one of these Smurf trucks yet. Sorry to see yours get wreaked.

    This is the exact reason when I’m turning left on a yellow I stay back and out of the open cross lane. I’m glad just your nose was out there and not your driver or passenger door otherwise it could of been much worse than the knee injury. Id be bummed too but you will get a new truck.

    I’m sorry about your accident and glad nobody was seriously injured. As a lawyer I can definitely tell you that the law is not in your favor with all the details you have shared. Alcohol consumption, no matter the amount, will always play a negative role in accident analysis. The fact that you were in the middle of the instersection during a red light will also hurt your chances.

    I don't know if this was mentioned, but refusing SFTSs can be a building block for developing probable cause for an arrest. Also, it's a Preliminary Breath Test, not portable :)

    Bummer man. Same thing happened to me last summer with my 17. I had the truck for 8 days and someone had a stroke or something and blew the light and t-boned me in an intersection. I hadn’t even reached my first fill-up. That one got totaled and then I had the dealer find me the exact same truck (almost swapped the inferno OR for a cement Pro but someone bought it before i got the chance). Then I was rear ended while stopped at a light with 5k on the new one while I was on my way to get my first service done on it.

    It very well may be preliminary instead of portable. Regardless, in Oregon it’s only the Intox 8000 we are allowed to use after we arrest someone. So please do SFSTs if you’re not impaired.

    This sort of accident is why it is absolutely necessary to get a dash camera.


    I was riding my motorcycle straight through an intersection as a light turned yellow. A Jetta was waiting the opposite direction to turn left, and booked it to turn left the moment the light changed. I didn't even have time to react, and she just barely missed clipping me. The minivan behind me was not so lucky, and they hit nearly head-on. Me and the minivan were going about the speed of traffic, and didn't accelerate to beat the light... The girl in the Jetta just floored it to get out of the intersection when it was yellow and assumed we would be stopping. The crash was bad, and I was really lucky to not be hit.

    It ended up going to court, and the Jetta that turned left was found 100% at fault, even though they argued that me and the minivan sped up to go through. The motorcycle I was riding, a Honda PCX, tops out at ~55mph and is absolutely gutless at about 50 (the speed limit on the road is 55mph), so the Jetta driver's argument was basically invalid. It's always the responsibility of the person turning across traffic to make sure it is clear unless they specifically have right of way (like from a green left turn arrow).


    If you have dashcam footage (or witnesses) and can see the driver ran the red / sped up, you might be lucky enough to be not be fully at fault... Without that, it's a he-said-she-said scenario, with you unable to prove the other driver sped up and the accident itself showing you didn't yield. You're at the very least partially at fault, but likely fully at fault without dashcam proof.

    Cars can be replaced, people can't. Good thing you have insurance, and good thing you came out okay.
