Drunk driver rearended us...

    Me either until the Tx DPS explained it. A truck delivering cattle feed turned left onto the ranch road from a state highway, right into the path of a car passing it. The car corrected back to the right but was unable to clear the trucks' rear bumper and thus "rear ended it". Leading to the cause was: the truck had a loose driver side mirror which allowed the mirror to move inboard when the ds door was closed (driver fault for not re-adjusting it). The truck had an inoperative rear left turn signal (drvr fault for not performing a pre-departure check) {drvr could have used hand-signals if inop blinker was known}. So the truck unknowingly turned into the path of a car attempting to pass it and caused the accident. Highway Patrol cited the truck for an "Unprotected Left Turn". (Car was split down the side from the truck's angle-iron drop-step bumper and also ended up in the bar ditch on the right hand side of the road. Family inside was NOT injured.)

    Got it. I for sure see the situation with that. I had been referring to a single lane road where someone was passing as most people do to get around a turning car on the shoulder or into the oncoming lane assuming there was no traffic coming in the opposite direction. In a multi lane I agree it could be a driver's fault that makes it impossible for another car to avoid them.

    Glad everyone is OK. You are fortunate that you were in a higher vehicle and hit by a smaller one. I was rear-ended by a 17 ton dump truck while driving a honda civic coupe. Bent the hell out of the frame and wrecked my back but I didn't die so that's a plus.

    I'm interested to see whether they consider it a total loss. I'm guessing they won't. You may need to fight it though I'm not sure how. But you know the insurance co would rather give you 21K to repair than 38K to replace....

    A friend of mine got in an accident just like that but he was cited for improper passing as the law states you are supposed to blow the horn before passing, that law must be 100 years old as you would cause road rage.

    I don't see how this is possibly true, considering that the bumper structure and the trailer hitch bolt to the same holes on the frame. Once you get all the plastic off the rear bumper, there's 6 17mm bolts that hold both the main bumper bar and the trailer hitch onto the frame.

    just make sure you contact a lawyer for a diminished value claim if it's not totaled out. think of it as mod money

    I called the insurance company today and a automated system informed me the truck is totalled. I will have to verify this with an agent but I feel strongly that this is the outcome. Thanks to everyone for the comments.

    Make sure to notify your insur ASAP that you want to get diminished value if they don't total it. I think we had only a week or so to get the paperwork in for them to process it on the diminished value piece.

    My 2018 was totaled a couple months ago. Frame was bent so Progressive said it was totaled. They also said salvage value is very high, so it makes their decision easier.
