    Hmm good question. Are aftermarket intakes illegal there? If so then this would probably follow along those same lines since it's a less restrictive air filter.

    Doing things like a CAI will result in a failed smog in California. The fact that is 'less restrictive' might trigger it, but I can't say for certain. Smog rules get weird.
