So as some of you know I have been have a second go round with my rear diff leaking. It’s weeping at this point, but not significantly as before the initial “fix”.

*I was not a part of the widespread Toyota recall*

My 2017 was not even in my possession for a month before it was in the shop for 35 days.

    Pre 1st fix:

    DFDE4EC8-F254-4606-A98A-B50746C3ECD2.jpg
    5391FF73-2788-4DB2-B455-8811639BE7EF.jpg

The truck was gone for 35 days and returned to me. I have intermittently been checking for reoccurrence and have recently noted seepage again.

    Truck now:

    A7586278-2A90-44EF-A961-26BC626FFC29.jpg

Now I realize that currently my truck is no where near as bad as when I first purchased... But not successfully fixed nonetheless.

I have already been in touch with corporate as I feel that this is something that should’ve never been an issue to start with and now is being addressed again since it was unsuccessfully handled in the 1st repair.

After doing some research I have been investigating the lemon laws in VA. I will attach them so you can look at them. It seems that I qualify for one of the 3 criteria due to the fact that the truck was initially gone for over 30 days.

    https://www.dmv.org/va-virginia/automotive-law/lemon-law.php

Does anyone else have experience with this, and I am just curious if I should even approach this avenue.

**I am aware this is gonna probably start a huge debate, but try and stay on topic. I just want to know your experience or opinion**

I love my truck but I also have lost faith in my dealership’s work, integrity and honesty and just want to know if this does reoccur if I should do something about it or at least talk to someone about my rights.

PS I am not determined to do this, but I’m still within my 18 month window and just want to know my rights.

Read carefully or consult a lawyer (often free consultation). Often then 30 days does not apply if there was a parts shortage which is why your truck was held so long. You technically only have 1 or 2 days in the shop. Also lemon laws often require 3 attempts to remedy the issue. You're at one attempt right now.

Couple serious questions for you. 1. Do you like the truck. 2. Was the first repair for the Diff leak and waiting on back order parts.

Wouldn’t this be the second time? The first fix was last July and now they are supposed to fixing it again. It’s in the shop currently. Just don’t know enough about this. Thanks though man.

Did you clean the area, re-torqued and monitored for any additional leakage?

    Try going to another dealer?

"The motor vehicle is out of service due to repair for a cumulative total of thirty calendar days, unless such repairs could not be performed because of conditions beyond the control of the manufacturer, its agents or authorized dealers, including war, invasion, strike, fire, flood or other natural disasters."

Read the law itself. Parts shortage is out of control on the manufactur so you're not past 30 days yet. And have had 1 repair at this time so give them another go to fix it. Still does it give them another stab and if it still does it the 2019 models are shipping now :D

Ok so, I would try another dealership if there is one close. If there is not return to the same dealership and request a different technician or a master technician to install the new gasket. I suspect that part of the issue is technician error on the new gasket. Like someone else said the 30 day thing is void if parts were not available. So you would be on attempt 2 to repair the same thing.

Definitely not going back to my current dealer after this. I’ve learned my lesson. This place is also an hour from me. Their service dept. customer service has really gone down. I will be using my closest dealer.

Thanks man. I’ll keep it for sure if I can avoid any extra crap. I just want it to be right. I planned on keeping this truck for a long time.

Take it from someone that works at a dealership, there are all kinds of levels of technicians in the shop. Don't be afraid to talk to the service advisors and explain your situation. Tell them why you want someone with experience to repair your truck. Do not bring up the lemon law cause every service advisor I know will shut down and be very little help once that can is open. Be polite and respectful yet firm. If you find a good dealer they will want to help. And i have worked for both really good dealerships and really really shitty ones.

I’ve definitely been polite but also firm in my commitment to ensure we get this handled. I understand it’s there job to help us, but they also don’t take the work as seriously as we do as owners.

What did upset me was when they did a multi point inspection and annotated there were no leaks. I brought it up with proof and they said it didn’t classify as a leak. Obviously I didn’t go for that one.

Sure it may not be continually dropping like it did initially, but it is still a leak of the rear diff. No vehicle should have visual evidence of seepage, especially from a known issue and be considered “not leaking”.

I will just keep my fingers crossed that this fixes it. If not, I will handle it as we go. I’m not as pissed as I am let down that my truck is having the same issue again and I want it the way it should be; with no leaking.

Absolutely and completely understand. We have a Toyota dealer in our group here and I know most of them including the guy that hands out the work. I consider myself very lucky in this aspect. As for the multi point inspection thing, every manufacture is going to them. We get graded on having them filled out and going over it with the clients. With that being said the manufactures still frown on upselling warranty work. If we do we have to get district reps involved and extra signatures and a whole lot of extra paper work. This results from the bad basically steeling. Aka completing warranty repairs that were never needed. Once again the many suffer from the actions of the few.

*Update* Just got off the phone with corporate and the plan is to replace the gasket, bolts, etc. and return the truck as quickly as possible. May be another day or two but that’s fine with me.

I just pray that it doesn’t return. I want to be able to leave this in the past.

If this were my Taco, I would not be looking at a buy back for a leak. There seems to be some odd challenge to solve this problem whether it is the gasket material or the mating surfaces. It should really be a no-brainer if it happens at all.

I think you are taking the correct path so far, IMO. That first leak was pretty bad. If this current fix does not work, I would push for a new axle and call it a day. Give them some good reasoning, such as you believe it is a manufacturing defect, you've been patient, and the axle swap is pretty easy for them.

I never thought of that as an option. That’s a really good idea though. Hopefully I don’t need to use that option, but you make a good point in the event it did come back.
