    Waste of time and $. Small claims court isn't free, and I'm betting the dealership has deeper pockets.

    I had something similar happen, but signed with lower payment and different options. When I got my papers it was changed and then it was filed with Toyota with all the wrong info. Toyota doesn't care.

    you don't appeal small claims court decisions. that is explained to you before you make your case. you waive that right to enter small claims venue where rules of evidence are more lenient and burden of proof
    is easier to meet. you get one shot but could always file another claim for a different reason. you will be on the hook for defendant's costs if your claim is frivolous.

    thats not true........i have sued someone and won in small claims court......with his loss, he appealed and lost again.....with the appeal you can have an attorney represent you......he did, and I ate her up in court.....won my 10K rental property damage suit

    BTW: cll court cost were paid by him...with interest....

    I know theres already a thread in the topic, but. Why are you buying an extended warranty? Maybe the warranty will pay for itself, maybe I'll be out a lot of money a warranty would have saved me one day. I just can't get behind spending the money on a piece of paper I might use one day.
    I still can't believe I bought road hazard coverage on my last set of new tires.

    :thumbsup: my knowledge is CA OR and MA. Small Claims Court different in every state (and even county). i should have mentioned that. none of them allowed appeal at the time.
    10K sounds hi for a small claims court but been a while since i paid attention. i know limits had been rising. attorneys usually not allowed in small claims so i am thinking you appealed to a higher court?
    yes, you can win court costs...but so can other party that is a target of a frivolous claim. original suggestion was to harass with claims...not a good idea.

    ps. not to hijack but your profile looks like CA or OR coastline. if in one of them, what county was appeal allowed?

    Yes....some states are different and have different limits......i did not appeal.....the guy i sued for damage to my rental house made the appeal.....he did lose first hearing and damages were awarded to me, so he appealed....in California if you appeal you can have an attorney represent you......he did this and it was a big mistake because his attorney was a personal friend of his and i ripped her to pieces in court....I got a second damage award which included all court cost and interest on the damages from the time of the first submittal.....then he and his attorney tried to let it go past 30 days but on the 30th day, my wife served him at his work for garnishment of his wages.....we had a check that night for $10k.....

    Small claims court will cost you more than its worth,even if you win,its up too you to try and collect.Suck it up and learn from your mistake.
