    Bikes do, in fact, have the same rights as cars, at least in the jurisdictions I'm familiar with, and are generally covered under the vehicle code.

    In California bicycles are not vehicles according to the statute that defines vehicles, but a person riding a bicycle has all of the rights and duties of the driver of a vehicle as provided in Division 11 – Rules of the Road – and certain other enumerated Divisions of the California Vehicle Code, except those provisions which by their very nature can have no application.

    This is a double edged sward because while it gives cyclists LEGAL right to use the roads, the cyclists also have to abide by the same rules, like stopping at stop signs, obstructing traffic, etc...

    The only time I can see needing to make the choice of who to hit (bike or car) is when the bike is traveling TOWARDS me in my lane, in which case obviously the bike is at fault (just as a car would be). However, when going around a blind corner, I travel only at a speed for which I can stop within the distance I can see forward. It doesn't matter if it's a bike that's obstructing my lane or a dead horse, or an alien spacecraft. If you can't stop or avoid *anything* in your lane around a blind corner, you're going too fast.

    Makes sense, just like how 99% of the time if you rear end someone you're the person at fault, even if the other driver slammed their brakes (or brake checked you) for no reason....because it means you were too close to stop in time. I think the only exception to that rule is if the other person's brake lights were out in which case it might be a shared fault situation, I'm not sure.

    I understand that bicyclists have the same rights as vehicles do on the road, but what drives me nuts is that they rarely ever abide by the rules (stop signs are the biggest one) especially in my area. So many times I've started going at stop sign after coming to a full stop, only to have a bike zoom past the front of my truck after they blew through their stop sign. And half the time they look at you like you're the asshole

    100% agree. As a cyclist myself, that's something that grinds my gears is the stop sign thing.

    The other thing I hate is when people are going down the WRONG side of the road (even in a bike lane). The bike lanes even have arrows showing direction of travel. Not only does this cause a problem when I'm in the bike lane going the correct way (now we have threat of a head on collision). When you're in a driveway (in a car) waiting to turn right, you're not typically looking for bikes coming form the right as they are supposed to be going the same direction as cars. I was waiting at a driveway to turn right onto the main road, and started to go when this homeless guy swerves in front of me FROM THE RIGHT. I about sh!t myself as I'm sure he did. Should I have seen him? Perhaps, but just like cars, that's not the direction I'm focused on when turning right onto a busy road.
