    I'm not sure that it is legal. My business was with PelfreyBilt Offroad, Inc. and they are attempting to discharge that legal entity's debt to me by listing me as a creditor in their personal Bankruptcy. If they are the sole owners of the business, they would likely have to shut it down in Chapter 7, but if they have their original investors as part owners, they could be attempting to shield the company from having to liquidate it's tooling and intellectual property.

    These people sound like great craftsmen, but terrible businessmen.

    At a minimum, they are certainly terrible communicators. If they are represented by counsel their lawyer needs to tell them to shut up. They are not helping themselves at all.

    You can't file a lawsuit to collect Now. Chapter 7 bankruptcy prevents creditors from pursuing further collections actions. The best option is the California Attorney General's office.

    I don’t have a dog in this fight. Just one observation as an outsider...

    If it’s true that some of you all had orders placed over a year ago with no delivery, then something doesn’t seem right. Remember, bankruptcy does not protect individuals from accusations of fraud. If they took orders knowing they could never be filled, that is fraud.

    Those bankruptcy proceedings will collect a lot of documents. It may be in y’alls best interest to hire a lawyer or at the least file a complaint with the California AG’s office. In the first option you all could spread the cost around to make it reasonable. In the second make sure you include specific people that had orders not filled for a long period of time as well as those who had orders accepted at a later date.

    When did the INC part come about with them. I'll have to dig through all receipts and see what they were in 2013. I thought they were sole owners but can not confirm. Someone with that capability would have to look it up.
