    damn, I really thought pelfrey's stuff was cool and dreamed about owning the bumper set one day. Buying any of this stuff is such a difficult decision and it's always such a nervous thing for me. Will it fit? Will it be damaged? Will it rattle? Is it really worth the thousands I'm spending?? How will I return it if it sucks?? Especially if I scratched it while trying to install?

    And then it turns out no, none of the stuff we all worry about was the problem, but instead the whole thing falls apart and you have nothing but a hole in your wallet. Sorry everyone for such a terrible situation. Glad to hear a lot of people are getting their money refunded and a good lesson to me to use a debit/credit card.

    Also glad to see Jerry stepping up with the discount on BAMF stuff. I rock his sliders and skids and love em! Hurry up and make bumpers already with that fancy cnc of yours!

    ACH is basically wiring them cash. It's what I did to save them the 3% credit card fee...which they asked me nicely to do.

    ACH payments are electronic payments that are created when the customer gives an originating institution, corporation, or other customer (originator) authorization to debit directly from the customer's checking or saving account for the purpose of bill payment.

    Aka, when you pay a bill online and it drafts automatically from your checking account... ACH Payment.

    They haven't lost a THING yet. Except for more money coming in for orders they weren't going to fulfill.

    Until the Judge hears the case and makes a decision, none of their assets are "gone" or "lost"... That part made me mad.
    Perhaps they know what's coming since they have a lot more experience with Chapter 7 than I do but as far as I understand no Sheriff's office has seized anything or whatever so that line was totally BS from them.

    Have gone through the housing bust, while working for a mortgage company... They will likely lose little to nothing for doing this. All the people I knew who filed at that time walked away with a ding on their record and all the money. Seeing as they have done this before I'm sure they know how to hide the things they want to keep.

    Nothing wrong with wanting to help and I think it’s great you’re willing to offer up this idea. On the flip side, the potential for this to go horribly wrong is pretty high and is the risk worth it? I think about all the possible “what if’s” I can and try to determine if the risk is acceptable.

    That is why when all of this started, I sent the ACH form via email to every @pelfreybilt.com email address that I had with the discontinue use of this account checked and so forth... I did that on the 1st and have email records of me sending that form with no confirmation or reply, so if anything comes out of my account using that ACH transfer... well... I won't speculate anything else on that. I just made sure to CYA.

    I believe they filled for personal due to personally guaranteed debits, that way their creditors banks, equipment loans, etc... cant come after them, ie their house, cars, personal items...

    Your business as the customer was with the company, so technically who you paid did not file for bankruptcy "yet". I imagine that to come next.

    The reason you are listed on their personal one is to prevent you from taking them personally to small claims. The business is not protected at this point and in my opinion that will be the next to go and be liquidated.

    Joe, you and I both know that if anyone who doesn't get their funds back through their own financial institution, that there is almost a sum zero chance they will be able to be compensated through the Pelfrey's Ch7 filing. That's just to cover their own asses so they won't be forced to give up their own property/assets.

    The one thing I can say is that their names/rep/standing in the offroad community is absolutely toast. People are going to remember this for a LOOOOOONG time and out of principle won't want anything to do with them. I'm sure they will find something else to do... just not owning their own offroad armor fab at least. Hopefully not, anyways.

    So they can cry and winge all they want about "losing everything" but all their material possessions will remain theirs. I'm wondering if they're looking into property in Iowa or Kansas right now kind of like the witness protection program since they are probably not going to get any warm welcomes at any 4x4 events on the West Coast any time soon.

    I am in no way wishing anything bad to happen to them physically. That's pantsonheadretarded. Some people posted some stupid shit on Facebook that I read today. Don't be that guy.
    I do however wish them to eventually be forced to get rid of their Lexux's and blinged out Tundy, etc. since that shit was gained under crappy business practices.

    They aren't chiming in because that's extremely dumb to do so at this stage of their legal woes. They shouldn't even be posting on IG but obviously situational awareness isn't their strong suit.

    Want to try to gain some trust back with the people and the community you f'd over, @Pelfreybilt ? Liquidate your extra toys and use that money to personally pay back the people who are not getting refunded by their banks. You'll get a lot more money doing that they we would passing the hat around here on TW and it may take a *little* sting out of some of this. You're choice to attempt to do more than you've done thus far.

    By the way: does anyone know how many people on the list of 77 pages are still waiting on refunds?

    :raises hand: lol, quite a few i'm sure. Sounds like the ACH customers are having some mixed success. I haven't seen anyone that paid via CC or debit have any issues obtaining a refund.

    So just to clear up some confusion for some people, Pelfreybilt was a Corporation not an LLC. So the Pelfreys filed bankruptcy personally as to not be liable for any personably garuanteed loans/debt to the corporation. When you incorporate you no longer “own” the company, you are an employee and you are to take a “reasonable salary” for the position your in, like a CEO. My point with all of this is that because it’s a corporation they can no longer just dip into the bank account and take money as they please, they have to account for any money that comes out of the business accounts. If they actually did take all the money and it’s not in the business account, and did not pay themselves as an employee, then the IRS would be very interested to hear about it. Also fun fact, if you call the IRS you can turn someone in for doing something like this and if they can prove it, then you will get a percentage of whatever amount they were charged. It’s called a Whistleblower award and can be up to 30% of the penalty and other amounts they collect.
