That is also why if I was someone that paid cash or ACH would be starting a law suit towards the company, the company is responsible for the payment to the customer and they have not filled for bankruptcy protection yet.

Exactly, and more likely than not, there is a good amount of money in that account.

According to my math, 579 listed on the document. That’s combined individuals and creditors. I doubt the list is 100% because I’ve had one individual ha reached out to me and he wasn’t listed on the filing.

    Interesting...

So I was looking on Lasernut’s Instagram page (because I wanted to see if they weld on the tabs for the light bars since my bumper came with them welded in the wrong place) and noticed they deleted these two posts from March 15, 2017 & March 16, 2017

    18EAF701-CDC8-4B37-8972-80B7B5BD5E97.jpg

They also unfollowed me and a few others that I know of some time in the last week. Not sure why. I’ve never contacted anyone from there. I didn’t even know they were the ones actually building the bumpers until I read through this thread.
We’d been following each other for a while. It’s just funny the IG posts got deleted since all this just went down. Someone must’ve started asking them questions?

Only at a personal level, the business as a corporation still is on the hook to everyone.

You have it right, they are listing everyone so you cannot sue them personally. At this point anyone could sue the Corporation and they would use assets to pay off debts, cash on hand, property or vehicles owned and such. The building is rented so they won’t be sold, so depending on what assets the corporation had, is going to be important to everyone being made whole from this.

    Snugtop, more to come!
    Just saw their IG post:

    • pelfreybiltoffroad#pelfreybiltfamily we owe you an apology for trying to over explain the horrible situation we’re in, whille emotions were high. The fact is, we should have just taken a deep breath, licked our wounds and expressed how deeply sorry we are for not being able to fulfill on promises made. We grew at a pace we could not sustain. We put our all into Pelfreybilt and exhausted every possible avenue we could find. We are truly sorry that we failed you. There has never been any bad intention and we always believed we could truly pull through this rough time; we were wrong and we are truly sorry. Our intent was never to blame you or anyone else for the failure of the business. In retrospect, we should have worded our post differently. None of this is your fault and we acknowledge that.

At least they aren't trying to blame their customers for this any longer, their previous statement was BS. Not much of a relief though for the 500+ people still pending their funds....

If this is true and they can no longer dip into their account. Maybe this was not intentional at all? They have a big chunk of money in the account that they cannot extract funds from.

Most likely to try to cover cost of materials or other debts.

My last contact was from Satin 9/6/18 telling me to wait "one more day for news from investors".
She sent it the very morning of the bankruptcy filing. Awesome.

Save that email and submit it to the courts. Methinks the bankruptcy judge is going to have a heyday with the Pelfreys.

Well, if it was to a Personal Bank Account and Not something under the Actual Company name... It could be treated as a Personal Loan... Which then the Individual Ch7 would "clear"...

And it wouldn't go into PB Company money bucket... IF there is any...
