    You need to go talk to a Lawyer (JAG maybe?) and get a filing into Bankruptcy court about this Property of yours before it gets auctioned off (if really still there).

    Third.
    If you have email records from someone at Pelfrey stating that your product was ready to be picked up and you then informed him that you are currently deployed and would not be back until October and everything. Keep those, print those off, turn them into PDF copies or something... your best bet is going to figure out where those products are and the way I would do that is by showing proof of payment via invoice, proof that they were ready, proof that you would be getting them on your return from deployment, etc and then sending that to the court as they are going to want to know that they had something that was paid for, waiting to be picked up by a service member that was deployed and it was arranged to be picked up upon your arrival back to the states. If that product is not somewhere.... they are going to want to know where the hell it is then.

    Fourth.
    Do you know if you were named as a creditor on the CH7 filing or not?

    Thank you for the advice. I was named on the list as a creditor. I had also ordered sliders for a 4runner, but that was early august amd got the money back from that as well.

    So they filed bankruptcy as individuals, how does that affect the business though? Or was it not an LLC and just an in-house business.

    From the filing it literally sounds like even though they invoiced, etc with Pelfreybilt Offroad, INC they were in fact a pass through business not a Corporation as the INC implies.

    Otherwise it makes zero sense to list their business customers as "creditors" on their personal BK filing and judge would toss it immediately.

    I was wondering what the invoices/sales agreements said. Did they have any other info besides Pelfreybilt Offroad Inc?

    Did the payments, both CC and ACH, process to the business name?

    So the merchant account was in the business name.

    Workin' on it....
    I have no money at stake in this whole disaster but I just don’t get how you can be listed as “creditors” on the BK filing. All you guys were “customers” of a business and paid for a product which you will never receive. It’s not like you guys are providing personal loans.

    I don’t get the legal side of this and how they as a corporation but not a company can claim everyone as creditors....
