Let's go to the park and remove all those concrete blocks. Then you can argue that the lot has no elevated structures either.

 

A good attorney would also point out the vague meaning of elevated structure even if they tried to push it. It's quite a far cry to lump a bridge and a concrete parking stop together. Also, the concrete itself is not elevated. It's in solid contact with the ground. The truck is elevated but that's not again the code. (I basically grew up in a commonwealth attorney's office and learned law ad hoc from them for years, haha)

 

If the officer actually shows up for court the judge is going to rip him apart. I've seen it many times before, and every time it is hilarious.

Ignore the LU, 17, 208, (a) because all that is is the code that gives park police authority. I think it's the VI, 5, B, (7) but I couldn't navigate the MD Annotated Code to save my life. Instead I searched "elevated" and found what I found.
