How can I get Toyota to pay for the other rusted components - including 1) U-joint 2) portion of air conditioning system 3) rusted power steering 4) actuator and who knows what else during my frame replacement that has been approved. Can I take them to small claims court for their bill for all of these 'non covered' extras? ( I know I can but is there a basis? Eric

What basis do you have to sue them. It's a 9 year old truck?!?

Hey thanks.... I love that answer! On the other hand, Toyota advertises that their TRDs can go on forever. I only have 108,000 miles on it. I'm a triple crown victim - Toyota crushed and paid me $17,000 for my 2004 Tacoma, replaced the rear springs that had acually broken on my 2009 and now the underbelly of is a total rust bucket. They knew or should have known that the replacemnt steel from ? country was shitty, but proceeded anyway. BTW, The actual Class Action settlement awarded $2,500 to each of the Plaintiffs. Eric

OP, It appears that your vehicle is well out of the rust corrosion warranty. You can ask the Toyota dealer to inspect it and see if they can replace it under their good will. If not assuming you have owned the vehicle since new, have you checked the underbody prior to this incident? at 9 years old and at 100k there's not much that can be done unless you are eligible for the frame rust recall.

No - I am definitely in the warranty that extends 12 years from 2009. Toyota has agreed to replace the frame, but not the other rusty underbelly components that don't work. Also there is 3 month wait for the frame to be constructed. In the meantime my vehicle is not easily drivable since the steel tube in the power steering have rusted thru and can't be fixed until the frame is repelaced. In the meantime I'm up the creek without a drivable truck.

Pretty sure the power steering is your problem,Toyota really is not responsible for you living in the rust area, that's on you.

Just like the frames Toyota continued to manufacture after their defective first generation of rust - my 2004 tacoma, they continued to look at their bottom line rather than help those of us up in the rust area.

I don't know about Toyota paying to fix all the stuff you want fixed, but I do think they ought to put you in a loaner truck for the duration. I was given a brand new Tacoma to drive for 2 1/2 months while waiting for my frame. I think it's required as part of the deal, actually.

    Not taking either side But,
Your 09 is covered under the class action suit not a lsc.
They are going to do what the suit says and replace your frame with allowing x amount of these and those to do it.
    Pending your dealer.
X amount of maintenance is needed by the owner to maintain any vehicle and lack of shows. Either maintain it for the long haul or swap often.
The owner of the dealership spent about an hour+ with me when I picked mine up.
First thing he said was you have a very nice Tacoma!
Lol I’m sure it’s been taking care of. My father in laws has moss growing on the back of the cab.
Buddy at work is in his second gem with a bad frame with less years/miles than I with no help from gem.

What advertisement did they put out that said their trucks go on forever without any replacement of parts down the line?

Firstly, cry me a river. You had some broken leaf springs boo hoo. If you don’t have to replace your leaf springs here and there... you aren’t using your truck like you should. Its a wear item.

You claim Toyota misled you in advertisements that the truck will last forever. Personal experience told you otherwise... but you keep buying Toyotas.

Just replace what you need to and accept responsibility for it. Its an old truck, shit is going to rust on it.

It’s going to be hard to take Toyota to small claims as Toyota is a large corporate entity. It would be difficult to sue them in a local state court.
And there are no open recalls on other items for rust... so no indication they have a responsibility to pay you.

In addition most Toyota owners do not have this issue, indicating its a personal problem. Toyota doesn’t owe you for that.

You are also not up shit creek without a paddle. You get a loaner car.

OP, you have more claim against the state and municipality for dumping known corrosive materials on the roads that cause rust then you do against toyota for the parts you want replaced due to rust. Of course they are pretty much sue proof.......................

And if they dump some of the newer stuff along with regular salt, it's much MUCH worse.

U joints fail from use or lack of attention to greasing them. If they rusted inside, that is on YOU.
