    While it is an elevated structure, the passage states "elevated structure on a highway or within highway tunnel"

    Therefore since this was in a parking lot, not an offense under that code. Maybe a different code, but not that one.

    Could be they just don't have one for "Parking Lot" so they just punch in the code for Elevated Surface and this comes out of the printer. All those numbers and letters in brackets and parenthesis after the description are the fucked up loop holes written in their favor.

    Generally though, if you take the time to go to court they respect that enough to kick it out.

    Definitely bullshit any way you look at it. Why even though I respect the profession, I constantly shake my head at the decisions.

    If I got stuck with it I'd go back and take the bumper.

    100% agree. The thing he has going for him is that officer is more than likely not gonna show up in court over a $50 ticket, so if Randy shows up and fights it, it shouldn't be too hard to get thrown out.

    For efficiency and convenience, the LEO already knows his court day before handing out his tickets and testifies in one fell swoop while defendants are all inconvenienced to take time out of there busy day to deal with BS fucking tickets like this one.

    I'm not so sure about this one since it's park police, so it's a little different. I have to mail in the ticket requesting a court date. We'll see what happens. I'm fully prepared if he shows up.

    Here’s was my BS ticket on the day after CHRISTMAS for having one of those plastic license plate covers on the Prius. Apparently it glares up the red light traffic lights. Merry Christmas NYPD!
