Pelfrey Informational Thread - One Post Condensed Version

Maybe they listed those within a certain timeframe? Example, all orders in the last 9 months? Just a guess.

 

Knowing of at least two others I would bet this is what happened, probably just logged into their sites admin back end and exported all the customer orders to a spreadsheet

 

If that's the case then what would explain people who made deposits and aren't on the list? Like myself

 

Probably method of taking that deposit, for instance, an export of an ecommerce admin backend would not include manual telephone transactions..

Did anyone else get a bankruptcy statement form in the mail with their names and all their information on it?

 

If you mean the Pelfrey's bankruptcy filing notice and case information, then yes. Many of us. I believe their attorney sent one to everyone listed as a creditor in their filing paperwork (which includes all of us who paid for parts and never received them).

 

Is it just to confirm to us that its happening or are we supposed to give it to our banks?

 

It is notice, which is required by law, that PB is filing for Ch 7 Bankruptcy and listed you as a creditor (someone they owe money or product to). You do not have to give it to your bank. The information in the notice is to inform you of your rights, hearing dates, bankruptcy trustee, jurisdiction of the action (San Diego), etc.

 

Just to confirm that is is happening and that you are on the list and what you are supposed to do, essentially you need to read it and see what your options are.

 

Do we know what inventory they have? I am thinking that if someone files for excemption from inclusion of their debt due to the products being available that maybe the court will allow recovery and include PB assets in the lot. I am not a lawyer but a precursory glance at this shows no mention of pelfrey built (the company) and it's assets. They can file for exemption of property and my worry is that they will ask that their company, IP and material property will be exempted as the company is technically a separate entity. They each listed us specifically which mean we cannot go after them, or the property they claim excemption from. I don't want to assume the worst but this is feeling like some wool is getting ready to be pulled over our eyes.

 

thank you for this thread. it is very informative for me trying to move forward. Michael was a great help to me throughout my whole process. I think he was just as shocked as us. After all, they moved him from out of state to help them. I feel bad for all involved. Vendors have started to reach out to help. I appreciate this forum and the community. You have any orders on with them? Everyone here in Hawaii is getting them.. and people who don’t have orders are as well. Looks like they just pulled a database entry and mailed it in with the filing claim.

All I know is NFCU stepped up like a G and didn’t even ask questions. They immediately fired up the Reg E investigation and are still going at it even after I told them PayPal got me back for the April payment. Guessing it’s just to double down that my money is good.

Anyway, people who accumulate debt fraudulently (as in accepting funds for an order you never intend to fulfill, and I've read in other threads that they did just that!) are not entitled to a discharge of said debt. But you as a creditor still have to file your proof of claim and thereby enter the BK case.

Didn't read this whole thread so this may have been mentioned already but it's worth repeating I figure.

Hopefully someone has contacted the San Diego Division of The FBI and voiced their concerns to an agent on either a cyber or financial crimes squad. Sounds like Pelfrey committed fraud up until the eleventh hour and need to be held accountable.

 

Yea brother, been waiting a little while for my sliders. If my dipshit self didnt order them wrong in the group buy, I wouldn't have been in this predicament.

 

Already in motion San Diego FBI Field Division, El Cajon Police Department and San Diego DA's office.

 

The San Diego office will most likely open a fraud investigation against Pelfrey
