    Prior to my old truck being totaled I forced the diminished value to both companies and they laughed in my face (in MA).

    I would think at a minimum you’d need to go well down the litigation road. Each state is different.

    I hear ya, they DENIED ever hearing of such a thing. I had to research (online and speaking with my Insurance Company) and find the direct number to their diminished claims department. This was in 2009, when I spoke with the other parties agent again they THEN acknowledged that such a department existed.


    Again, if you want an honest FAIR value determined it may take litigation, if you want to settle for what they deem, say in my case $5K of damage and a settlement of diminished value at $1,100, I accepted it as an easy finish.

    He hit them, pretty much always going to be at fault in that situation. Just how it’s viewed. Unless the lady was being reckless which it’s obvious she wasn’t. Only chance you would have would be to try and sue the driver who ran the red light. But since hat person wasn’t involved in the accident good luck trying to get their info. Even if it was in a traffic cam or something, the amount it would cost in lawyer fees, would probably be greater than any deminished value payout you would receive in this case.

    Two problems:

    1) I'm in CA and I don't think this is the case here
    2) I was found liable because I hit the rear of the car in front of me even though she slammed on her brakes because someone else had run a red light...

    The thing is, when you already know how to drive. Are you going to wait for a vehicle to beep at you? The beeping confuses me, and causes a few clicks of a second, delay in my reaction time to what ever the vehicle is beeping about.

    Ouch. My bro had an actdnt and could barely afford repair. He drive without insurance after that for a year even tho I told him not to got stopped one time but cops didn't ask for proof of insurance he got lucky and finally but insurance after that again only libily thought haha

    If it's not your fault and your truck is new, ASK for diminished value!!

    Also, I feel your pain. A young girl on her cell phone ran a stop sign and slammed into me while I was driving my husbands BRAND NEW 3rd gen when they first came out-parts weren't even available to fix it yet!! Talk about a few months of hell I went through!! :(

    TSS doesn't stop the vehicle. Only warns you. OP doesn't recall if warning happened or not.

    I don't have have TSS since it's a 2017, but why is it different than other brands that actually applies the brakes for you Like Honda, Mazda, Subaru etc?
