    The frame needs to be replaced, therefore the frame is a total loss. They aren’t putting it on a frame machine to repair it, they said they need to fully replace his frame.

    I never said the truck was a complete loss

    That's the first time I've heard someone refer to total loss when explaining a frame. Total loss when discussing insurance is in reference to the vehicle being a total loss.

    You don't see many people backing into a light pole and saying, my rear bumper cap is a total loss.

    If you took a minute to read my comment you would of understood instead of rushing to post a comment, probably because you’re upset I called these frames junk. I mean I could of said destroyed, but then you could also argue that as well. Whatever you’d like to call it, the insurance adjuster/company is saying the frame is damaged beyond safe repair.

    You do realize that Toyota replaced a lot of frames on Tundra that had the frame rust issues? Just because the frame is bent, doesn't mean that it is a total loss. Just another part that need to be replaced as part of the repair.

    Wtf are you talking about? You started talking about rust then you talk about it being bent, then some jibberish.

    Rust has nothing to do with this accident. His frame is obviously badly bent. A frame machine isn’t going to fix it, hence the replacement. I’m sure some redneck in his garage with a 30 pack, torch, plasma cutter and a welder could get it good enough to drive. However an insurance company ain’t going to go that route and Toyota, if I remember correctly, states not to heat these frames for any type of frame repair.

    That sucks OP. 80% is higher than most states but I suppose it is what it is. I can't say I'm really surprised. This is definitely not the first time this has happened. If it were me I would do everything I could in an attempt to get it totaled but if that wasn't going to fly I would likely push for a very high diminished value claim and sell it as soon as it gets "fixed". Could start negotiating the sale while it's being fixed and use that as leverage for the diminished value amount. Won't be easy but it's the hand you've been dealt so just going to have to play it.     They say $17,000, which means that it will probably be closer to $23,000. They tell you it will be 6 weeks which ends up being 12 weeks because they cant get parts. They will have to pay for a rental car. Since the frame is toast, and the amount of damages, you would think they would just total it, take care of you, and then subrogate.

    For shits and giggles, call a Toyota dealership and ask how long it will be to get a complete new frame. Hell, I can't even get a windshield for my truck.

    Update: After a whole month of going back and forth with the collision shop and my insurance adjuster, I was told a frame replacement was needed. ETA for the frame is 30-60 days, this is for the frame itself, DOES NOT include the repair time. All said and done, my insurance adjuster still would not total out the truck. On top of that, my insurance over covers up to 30 days of rental, that coverage is coming up soon. The adjuster told me to go through the other party's insurance since they "should" cover more than 30 days. I'm caught on the fence of filing a lawsuit. 4-6 months to repair my truck?

    Any advice is greatly appreciated as I do not have much experience with this.

    Wow. This is why all states should total any vehicle that needs a frame. I'm sorry you have to deal with this. I hope you get good advice on here. I'd probably be getting a lawyer myself. Good luck to you.

    The adjuster can extend the rental car as long as needed. If the parts are not available or backorder, it isn't your fault. I recently had one for 4 weeks because a part wasn't available. The body shop dealt with the insurance company.

    The frame swap should be pretty quick. A friend of mine had his tundra frame swapped and it took 3 days. Your repair should go real quick. They can get the bed in and paint it and get it ready to go. Since your truck is new, all the fasteners will come off easy and assembly should be a breeze. I would be shocked if it took more than a week once the frame arrives. Undoubtedly you are getting all new genuine Toyota parts and the only thing not Toyota will be paint, but since it is new, that shouldn't be an issue. It isn't like they will do any body work so no cutting and filling to worry about.

    The only real gripe you can make is the diminished value post accident because undoubtedly it will show up on Carfax. People telling you to call a lawyer obviously don't know this game. A lawyer will just end up costing you more and probably gain nothing more than you can get on your own.

    I would put your insurance company on notice that you didn’t receive the benefit of your bargain, the very contract thought to raise and limit your actions...if the accident occurred less than 24 months from the date of purchase they are required by law to repair the vehicle with all factory oem parts and you would also be entitled to the “diminish value” of the vehicle after the repair is made...I would send them an invoice for the diminish value of the vehicle.
