My truck got rear ended... is it totaled?

True that is not always the case, in general, based on my experience insurance companies will not want to deal with the likely cost of fixing a bent frame. 10k into a 5 month old 4R is certainly a lot more reasonable expense than it would be into a 2009 Taco since a brand new 4R is worth a hell of a lot more. 10k+ on an older Taco and were probably creeping into the territory of it being cheaper for them to total it and write a check than to try and fix. Either way, glad they saved your vehicle, and I hope it works out well for the OP.

 

Glad to hear you and the wife are ok, OP. You did the right thing by hiring an attorney. Every case is different, but I got a brand new frame when I got rear ended last year. $20K repair cost and $3K awarded to me in diminished value. Insurance companies suck. Hope everything goes in your favor.

Hmm five year old Tacoma vs. what's coming up on a ten year old Tacoma

This is an example of what a rebuilder I live close to gets in all the time. Granted it's a 2WD, but insurance companies seem to total them out for the lightest hits. Even if they could "fix" it you're not going to want it back

You're suspension is jacked, a frame check is completely needed. So much is shoved, if I were you - Id hope total that.

 

That is very minimal compared to mine.. yeah that’s true. I wouldn’t want to have it back if it won’t be fixed the the fullest 100% . I’m just down at the fact my work on the truck is something I was proud of. I didn’t have long travel goodness or have it totally 100% overland or desert runner compatible but, it was dialed and I was proud of it.. sucks big time

 

Seems to be what most are leaning to. Looks like I’m on the road for a new project.

 

Okay, one thing I’ve been contemplating. All my aftermarket suspension, my wheels and tires, and my camper. Will I be able to keep those items? My car is currently at a collision repair facility awaiting my insurance adjuster. I also do have all original parts.

 

You should have had it towed to your house for that. It's going to be tough to convince the collision shop and insurance to let you tear down that truck at their facility. You may still be able to negotiate it, but you will need to pay for the tow to your house and back to the repair shop. You will need to stand your ground that is the path you want.

 

Who is your insurance and who does the other party have.

I do have AAA but, I need to speak to my adjuster to settle with the repair shop on releasing my car because of storage fees. Definitely would want to go the path of keeping my parts .

Buy it back from insurance and back half it!

THe rear frame is so weak on these trucks you can almost bend it by hand.

If it didn't crumble you can bet your neck would hurt more

 

Then you are going to need to stand and fight to get that truck home.... insurance should give you about 7 to 10 days to get those parts off and replace them back on the truck.

 

Well if he is not at fault the other guys insurance must pay for his mods too, right? Up to the liability limit of course.

I hope this is the case. I hope they allow a grace period for me to bring the truck back stock to how I bought it off the lot and take my personalized aftermarket parts. The only thing I actually paid for was my camper, rear shock tuning, and my 600lb king springs. The rest were actually gifted to me. So it’s more of sentimental value. Like the tires have wear from Offroad and drifting but, they were a gift so I want them back. Yup. Hopefully 7-10 days is an option.

 

Maybe. When my high school ride got totaled by someone else, they didn’t compensate for my aftermarket parts unless I had receipts of them. They also didn’t pay the full amount, they paid it as if they were used for 150k miles which was the mileage that vehicle had.. so I think I’d rather take them back.

 

Play hardball. You got a lawyer. Use him. Threaten to sue them in small claims court for the value of your mods.
You can get pretty far by not just folding right away

 

Just a suggestion, edit you original post to remove all identifiable information such as location, date of incident, time of incident, where your truck is etc. I would also edit your photos to remove license plate numbers.
You give a lot of identifiable information that is discoverable in any litigation. Anything you post online that can be linked to you can be used as information in the pending case.

Just a suggestion. Consult with your attorney on this.

If your frame is bent its a total loss.

Your personal injuries are more of a concern. Worry less about the truck and more about what matters.
