Need advice on dealership abusing my truck

    I would advise against uploading if there is audio on the recording.

    Doing so could oiss off the dealer to label you a criminal, and refuse service.

    You likely have loopholes to avoid being prosecuted, but it's not worth it.

    Handsling this with discretion, at the appropriate levels is the way to go.

    I also doubt he'd get into any serious trouble if his state has restrictive audio and or video recording consent laws. But that doesn't mean the dealership wouldn't sue him based on no consent recording because they've already shown that they are kind of jerks. Sure, he might win in the courts... but he'd have to go to the courts and my initial impression is that he's not a lawyer and likely isn't going to represent himself.

    I am not a lawyer, but if the dealership sues because they think he damaged their reputation by illegally recording them... it'll suck because he's going to have to defend himself and get a lawyer.

    I agree. There is essentially not a thing as zero party consent.

    So you are right that this recording does nothing for him in this case.

    I had a tech steal something out of my car once and the BMW dealership threatened to sue if I uploaded the video. Of course I did, but not before filing a police report and showing the video to them.

    They went to the dealership and arrested the tech. The statute of limitation expired years ago so I guess they decided filing a public lawsuit was not a great way to keep this quiet.

    Great....I’m reading all these horror stories while I’m in the dealers waiting room getting my 5k service. Oh....and they informed me the oil is not changed until 10k service.

    Get a dash cam! and put a few gopro under the hood and under the rest of the car.

    After working in a dealer for 6 years, I have zero trust of the techs that work on the cars. I do always mark everything that should be replaced or done at each service. If my mark is still on the oil filter when they say they changed it, you bet im going back.

    Had a private shop tell me they did a 4 wheel alignment on my 1987 bmw 535is. I asked how bad the rear was. They said is was bad, but they fixed it. Then they gave me my money back when I told them the rear end is non-adjustable.







    For those who want the videos, I have them all labeled and a little summary of each video ready. Will probably post after I talk to the dealer if they are less than helpful.

    Or, you could just take your stuff to the dealer instead of posting it on the internet. The internet can't help you. The real people at the dealer can.

    This is no different than using a dashcam when driving for Uber or Lyft. There are a ton of small stickers that you can put on the vehicle that clearly state video and audio are being recorded. I would put one on even if I didn't have a dashcam to make sure the techs know its LIKELY in your vehicle.

    I have a GPS that is also a dashcam in addition to my obvious dashcam. I have had techs unplug the dashcam and not the GPS prior to snooping my center console and driving my truck to a fast food place to get lunch. One tech even called his girlfriend while test driving my truck to tell her he was sorry about last night and how he was still totally drunk and might go home sick. Service manager LOVED that video!!

    I have yet to find one Toyota Dealership that can do a front end alignment properly. from my personal experiences, its almost better not to pay the Toyota dealership for a front end alignment and go to a shop that has proven track record in alignments

    most of the time the steering wheel is off center right and they bend the cam adjustment tabs trying(failing) to get the proper camber. best bet is to go to a shop who has positive reps online and word of mouth from Tacoma owners on who does a good job. probably would be a great thread to start on rating shops that you've dealt with as far a repairs to your truck at least you would have a good idea who to avoid and who gets the job done right.

    It is slightly different.

    The driver is present in the Uber, and in one party consent laws, he is the party that provided consent.

    If you are not present, then even in one party consent states you cannot consent.

    The sticker aaffords some defense against civil and criminal suits, but that is in the hands of the jury, or prosecutor.

    Also.. my guess is the user agreement when signing up with Uber or Lyft probably indicates you consent to being recorded. But who really knows, the text of the user agreements we all blindly agree to is a mystery to even modern science.

    This part is what gets me. How is having a dash cam in my car different than having cameras on my house. If I'm not home then the single party who consented is not present and all recordings would be in violation of this single party consent.

    The vehicle has built in cameras already, who consented to those

    It seems to be too gray of a area

    The key to any wiretap/eavse dropping statutes is "expectation of privacy". So without consent, it is permissible if there is not a reasonable expectation of privacy.

    1. An invited guest has a reasonable expectation of privacy in your home. More so in bedroom, bathroom etc.

    2. Anyone committing a crime by trespassing has zero expectation of privacy.

    3. Audio is different from video in many states.

    4. Most security camera don't Auto record audio, must be activeated by one party.

    Same reason a person throwing a fit in public can legally be recorded.

    Same reason a police trap car can record a thief without a warrant.

    In this world... it's all in who you know. My advice would be shoot the shit with the service tech you hand off your pickup to. People are always willing to go the extra mile for someone they have a basic connection with. Make a friend... and you won't be so worried next time.
