    If you are unhappy with the vehicle and it can't be fixed to your satisfaction, sell it. I've had my share of lemons over the past 45 years.

    I feel bad for your situation, but just trying to interject a bit of reality. Those calling you to "lawyer-up" haven't the first clue of what they are talking about.

    I don't have the time for that. I would be happy if they gave me some sort of trade in credit for another vehicle but that wont happen.

    You paid an average price for an average truck. $40k is a cheap truck and barely over the average cost of all new vehicles bought in 2018. Hyundai’s can cost $40k also.

    True, if issues arise down the road they might say its past their coverage and they fixed the issue. Would be worth calling Toyota corporate to get that stuff replaced or covered in case future issues happen

    My thought exactly. Only replacing the carpets for a truck that's flooded a handful of times or more doesn't seem like enough.

    A settlement vs having a vehicle bought back is not necessarily the same thing. Just having your vehicle bought back does not mean you aren't allowed to talk about it, unless for some reason a non-disclosure agreement was put in place.

    My family has had two vehicles "bought back", a 1990 Oldsmobile (mom's car) and a 2011 Ford Raptor (my sister's). Once the dealers realized the vehicles would fall within our state's lemon law, and that the customer (mom/sis) were going to go that route, they bought the vehicle back and got them into new vehicles based on the lemon law's calculation of fair use or whatever it's called. In neither case was a non-disclosure signed.

    Thanks for clarification. I am not looking to sue Toyota, however I would like them to purchase the truck back so I could buy another truck or an SUV. I'd assume a buyback would get me more than a trade in.

    I'd give them good faith for the first two times but this has been leaking for a year and I have brought it in now 3 times.

    WA Lemon law spells things out extremely well. It's all through the State's Attorney General's Office. You don't need a lawyer here in WA. You pretty much look at the requirements to meet lemon law, get the documents together, right a letter, certify it, and send to Toyota (can't recall dealer or corporate). They are supposed to respond in a certain amount of time. If they don't, or they deny, then you begin working with the attorney general's office. My sister was assigned a person who handled her case. Originally it failed as it went to like 29 days out of service, not the required 30. VERY shortly after, the truck was in the shop again for another 5 or 10 days. She sent another letter like the first, and Ford went ahead and offered her a new truck for X dollars, based dollar for dollar off of the lemon law calculation of what they'd HAVE TO buy it back at if the AG said, yes, this is a lemon. I've heard that if they buy back without the AG saying they have to, Ford doesn't have to call it a lemon and can sell as a used vehicle. Whereas if the AG says it's a lemon, it will forever be known as a lemon and that must be stated up front anytime someone looks at it on a lot.

    I'm no lawyer, and this is just the general gist of the process. It took MONTHS from start to finish of the entire process. In the end my sister had to pay around 5k for a 2 year newer truck that, knock on wood, has treated her very well.

    If it smells like mold when they are finished I'd definitely bring it up. Otherwise, while it may be in the back of your mind it's likely as good as it would have been and has new carpet. No-one else will ever know.

    hiPSI would state:

    This is a 40k truck, not a 66k truck. Leaks are gonna happen and you shouldn’t expect more... it’s not a Ferrari. Throw some glade stick ons under the seat and don’t worry about it.

    The dealer and corporate Toyota is not required to do anything but fix what is broken.

    Vehicles are depreciating assets. You can’t be upset that your vehicle loses value. Thats just life.

    You might be eligible for Lemon Law buy back if this is your fourth attempt to get this fixed.

    The lemon law clock already expired for him. The best he can do is open a case with corp and get them to approve replacement of the seats and other parts.

    The dealer isn’t gonna do jack.
