The marmot under the hood is a new one for me haha.

I’m talking damaged body panels not destroyed mechanical parts.
Most insurance companies will not buy you brand new panels for denting that can be popped and sculpted.

I remember reading about you and this story or possible someone else with the same story. I know it was in CO and I'm pretty sure it was Denver. Did it make news somewhere or published somewhere else? Can't remember where I read the story now.

Yeah I posted it up here. Think I may have had pictures of the damn thing after I caught it. The shop did great work. Been over a year.

Yeah man, was probably here that I read it then. Not funny that your truck was damaged, but a pretty funny story aside from that you'd have to admit. Sorry to go off topic here op, I'm sure you'll get your truck repaired like you did your last one and this will turn out well for you.

Originally not Expo AF! Kinda Expo AF now...lame.
I know a lot of people are upset when they get their first damage and I get that. I'm currently nursing a truck myself and would like to keep it pristine. However, I finally scratched the wife's 4Runner on a trail and now I'm over it. It's kind of liberating. Not going to tear anything up on purpose, but the pressure's off. It's all in the outlook.

Time to start wheeling that thing and really enjoy what it can do for you :)

Not the OP. Still have that truck though. That mountain gopher did that shit after only having it for a month though. Was pissed at the time but yeah, funny story now. Especially when I see marmots out now, I give everyone of them the bird now. It was about 3 weeks without the truck I'll never get back...

If the accident happened less than 24 months from the date of purchase then the insurer is required by statute to use OEM parts at least that’s the law in my state.

You can go through your insurance and see if they offer OEM. You'll have to pay your deductible, but your insurance company will recover it from theirs if you can take a temporary hit.

    This is interesting. https://scrs.com/wp-content/uploads/2017/09/statecollisionrepairlaws-crash-parts-steering.pdf

    For the OP:

In New Mexico, the vehicle owner has the right to know whether the parts used in the repair were aftermarket, used or rebuilt. If a shop or insurer fails to disclose this, it will be assumed the parts installed were new, and will be warranted as such.

In New Mexico, the vehicle owner has the right to choose any repair shop for the repair of that vehicle.

    Where as in Indiana:
In Indiana, the vehicle owner must be given the opportunity to choose in writing the type of parts that will be used in the repair. This applies for five years after the model year of the vehicle.
An insurer that fails to offer the vehicle owner this opportunity or specifies parts different than those selected by the owner is committing an unfair claim settlement practice.

...And if it's any consolation, I struck a tire at 60 mph that was just laying on the freeway this morning (pre-dawn) and trashed the lower bumper on my Audi TTRS... :angrygirl:

Not sure how #4 will make an OP an ass hat. If the offending party's insurance is not willing to make her whole (provide same parts she had on the vehicle before the accident) then she has the right to recoup the difference by any legal means necessary. I did it and I would again if I had to. No shame, no regrets.

yeah, I knew you weren't the op. was just apologizing to him for going off topic on his thread. Didn't realize your truck was so new when this happened, I would have been livid. I've seen in Mineral Kings (Kings Canyon NP) where people have to put chicken wire around their cards to keep them from tearing their cars up. I parked there without knowing this and came back after a couple of days to see other cars with barriers put up around their cars/trucks. Nothing happened to my truck luckily.
