    Why would you pay a deductible when it wasn't your fault? That sounds odd. You should be dealing with their insurance company and not your insurance. That is who you should be filing the claim with.

    He wanted his truck fixed, and at the time did not have the information for the other driver. Typically your insurance co. gives you the option of filing the claim with them (paying your deductible), and then once they settle with the other insurance co. the claim is no longer your problem.

    I would never deal directly with the other insurance company. I pay a lot of money for my insurance and part of what I am paying them for is to handle accidents, regardless if they are paying the claim or not. When I was rear-ended I called my insurance agent from the side of the road and gave them the info. They handled everything from there.

    That is a foolish idea. You have a claim, you spend money unnecessarily and your rates go up. You insurance company doesn't care are about you and they don't represent you unless their money is at risk. I think you have been watching too many all state commercials.

    Not sure if you quoted me by accident, but that's not how it works.... The insurance co. collects from the other insurance company and you don't have a claim against your policy. They do represent me because I am paying my premiums to them. I do happen to have Allstate, so maybe you are right and they are the exception. If my insurance company didn't do what I described I would be looking for a new one to give my money to.

    OP. hasn't been here since July 14th and his last post was on May 26th (this thread).

    1. He may have had to lawyer-up, in which case his lawyer told him to stop posting here. He smartly listened to his lawyers advice and he is laying low.

    2. He outsourced his investigative work to us and then ditched us at the gas station. :angrygirl:

    LOL yes this is in the hands of the lawyers now. I've been advised this could be a long process but thanks to everyone here who assisted in my quest, I am a hell of a lot closer to getting this resolved than I was. Thank you all!!

    Make sure you get them to pay your legal fees for having to deal with their bullshit. You should be absolutely zero out of pocket for this nonsense.

    For those who have been interested in how this would turn out. The trucking company paid up and I got my deductible check today. Not only did I get back everything I had to pay but also an extra $1500.
