If they buy back are they also getting you into a new truck? Like for 8k off?

The reason I asked is that if it WERE a lemon (i keep making this disclaimer that i'm in WA) then the taxes paid would be handled differently on the replacement vehicle, but with a buy back you really don't get any special treatment.

That is the formula I would use as my starting point in considering offers.

We don’t know if OP is misusing the term buy back, if not why the buy back is occurring, or what state the OP is in.

I’m not going to get in an argument about it either.

This is a buyback as part of a lemon although says ‘for customer satisfaction’

I’m not sure of the legalities or talking about it. Toyota carporte is offering to buyback the truck due to the amount of issues it’s had and amount of time it’s beem in the shop. It’s not a dealer offering to buy it, corporate sent a fancy letter with the logistics including the tax, fees etc I’d get back. However, it did say 8k mileage deduction.

O yeah, not trying to argue. I'm just betting Toyota is using a formula like this and looking at local Lemon Law stuff to figure out what to buyback at. That way they can point at the local laws and explain why if they need to. If he can talk them into a better deal, that would be great!

No matter what, this sucks... OP is prolly gonna take a hit, or he'll sell it elsewhere and someone else will get screwed. Although Toyota might end up doing the same thing... I've read that if they buy a vehicle back they can treat it as any trade in, and don't have to pass on any information to a new buyer, where if it went through Lemon Arbitration before they took it back, the first thing outta a sales persons mouth if a person looks at the vehicle on a lot is supposed to be this was a lemon.

If it was me, I'd just look to get me the same truck. No upgrade or downgrades.

I would ask what the mileage offer / deduction is in writing.

Talking out of my ass, this doesn't sound like a lemon law situation since it doesn't appear that you initiated it. Just customer satisfaction as they noted?

I asked them to buy it back as a lemon, they agreed.

Read the “Owner’s Warranty Rights Notification” booklet that came with your truck... was bundled with all the other owner and vehicle type booklets you received at purchase. There are specific lemon laws by state in the booklet that may assist in your decision. Pages 1-7 provide specific steps for all warranty and customer satisfaction concerns... best advise (IMHO) is to follow those instructions (claim form is in the middle of that booklet)... binding NCDS attribution for Toyota, but not you.

Oh. I guess you are now going down that path.

You might want to ping someone local to you to see what your limitations are. Like I said above, used 2017 Sports are being sold for just a bit below sticker here.

WA has a 2 year/24k mile eligibility period for lemon law, and a quick google search shows Mass only has 1yr/15k miles eligibility. Sounds like Toyota might already be going above and beyond what would be required by local lemon law (barring the fact that one of the ongoing issues started BEFORE the period ended).

Personally, I'd prolly go through with it. Perhaps see if they'd deal a lil on a new Tacoma, but as it's coming from Corporate not a dealer, not sure how that would work.

I wish you luck in whatever you decide. Sorry to hear about the truck. I will add here that my sister's replacement Raptor has been PERFECT for far longer and more miles than her first one lasted, lol. I hope the experience doesn't ruin your opinion of Toyota.

I was just on another thread about this not too long ago. People worry about talking about it. If you haven't signed a non-disclosure you are fine. Even after Ford bought back my sis's truck they didn't make her sign one.

Only if they tell you not to or you sign something that says not to.

My intent in the last post was someone offline. Your state website or the responsible office should have some good information.
