New Truck Wasn't "New"

Do you get a tax incentive in CA on your trade in? In NY you only pay tax on the difference between the trade in and new vehicle. Not sure if CA does that too. That could be shitty for you if you still sold it to them but didn’t buy a truck from them.

 

Contract seems to require arbitration and dealer to pay first $5,000 in arbitration fees. Both sides to bear own attorney fees.

 

Yes CA is the Same. You only pay tax on the difference (since you were already taxed on the prior)

Then go buy the model you want that's 100 miles away. Some deals are spoiled from the get go...

 

I would think the laws regarding contract cancellation would apply. Do they still have your trade-in? If not they have to refund you under 11713.21:

(2) If the buyer was not charged for the contract cancellation option agreement, the dealer shall return to the buyer, no later than the day following the day on which the buyer exercises the right to cancel the purchase, any motor vehicle the buyer left with the seller as a downpayment or trade-in. If the dealer has sold or otherwise transferred title to the motor vehicle that was left as a downpayment or trade-in, the full refund described in paragraph (1) shall include the fair market value of the motor vehicle left as a downpayment or trade-in, or its value as stated in the contract or purchase order, whichever is greater.

 

Potential to make money on this deal.

This is a business transaction with a contract that is the controlling document. What does it say?

Generally, if you entered into a business deal with someone, signed a contract, and they misrepresented the item or violated their contract then they are obligated to "make you whole". Rescinding the deal where you have every single thing you had before the sale down to the penny...you could even argue they owe you for any gas, missed hours at work, etc (I dont think you want to go that route bc that seems petty tbh). OR they can give you a new truck that's the same trim level for the same agreed upon price.

 

i say bull shit to that.....it can't be a dealer saw if it has been registered to another individual......do not let them talk you into a paperwork re-do....Demand a new vehicle.

 

So give it back to them and then make an offer on the used truck.
