True, but that's where the severability provision comes in. The rest of the contract (i.e. trade in deal) is still valid and must be honored.

 

Your position needs to be new truck for the agreed price.

If they aren't willing to offer you a discount on that used truck, then call the deal off and wait for them to relist the truck as used and offer to buy it for less or go elsewhere.

 

They wont agree that it has used truck value.

 

I’d walk away at that point.

 

Earlier in the thread you said a new truck. Now you are demanding they take your trade and let you buy the truck again at an additional discount.

If it were me, and my trade had not been driven and mettled with, I would have walked.

So make that part of it or say you'd like to go to arbitration. They have $5k skin in the game. My guess is that it hasn't gone high enough at the dealership for someone with a brain to review the entire situation. They will most definitely lose their "case" since they are in the wrong. Explain the math to them and let them see what they have to say. "I'm asking that you drop the price $2k, since its used and you misrepresented the truck during the sale, or we go to arbitration where you spend $5k to have the case settled as a nullified deal or you give me a new truck. "

 

very difficult to get previous owner info in California......it a privacy issue and dealer will not give it to you.....you can ask then to call the previous owner and see if he will talk to you.....but if they had issues it may not be too good for the dealer

 

Leave them the truck, get your trade in back and any other cash you may have put down, and go somewhere else. The deal you got on the truck was not that great anyway, sorry to say. I know it varies by region, but right now in my area Toyota is giving 1,000 cash back right off the top. You can do better at a better dealership.

Ask for the 2grand difference in a check. Keep the truck, you didn’t have an issue till that phone call.

 

Yeah I would take a new truck at the prior price. I'm not trying to get rich. I just want the hassle to be over.

I’m betting your dealer got a poor deal on the “dealer to dealer” swap, and can’t take the “used” truck depreciation loss... I agree with most others here, walk away from this deal (get the cash for your trade) and go to another Toyota dealership and get the NEW vehicle you want. Patients will get you the perfect Tacoma...

 

I think the pragmatic thing to do is something like this. Unfortunately, the dealership is being a little dodgy too.

I'd say op needs to keep going up the chain at the dealership, professionally, until he gets someone with real clout and a brain.

It's on their lot. Once I cleaned it out and signed the DMV transfer, it is theirs.
