    Exactly my thoughts. He paid for a new truck, meaning he's the sole owner period. Mileage doesn't matter as much. He wants to know he's the only one who's beat on it.

    Dealer is going to try to get out of this situation by doing as little as they have to. They already tried to get him to come back and re-sign paperwork. I mean you really think if he doesn’t say anything that they wouldn’t just redo paperwork and make him pay the same price?

    yes i under stand that it has some miles on it but, what did he pay ? was it already 3K under MSRP or sticker ? if it was sticker then id be pissed, did he get a sweet deal ? then not as much off as you think.

    Not what I am saying.

    He doesn't have to keep the truck, or resign on it. He can simply say he doesn't want this one anymore, and either drop it off and go elsewhere, or get a different one from them.

    The contract is void at this point. The original contract had an error and regardless of what the dealer says to try to scare him into keeping it he has nothing binding him to do so.

    Speaking from nearly a decade in auto sales Im telling you that if that truck was returned at 400ish miles it very well could have a major defect that the dealer is hiding. Dealerships dont make a habit out of letting new vehicles out the door before the bank has "bought" the deal & finances are secured. So we can rule out the possibility that the deal just fell apart, or was kicked back by the bank afterwards.

    Id say it carries too many risks associated with the truck and if It were me I wouldn't take the chance.

    Ok I can agree with that. I would probably also beat the piss out of the truck then drop it off at the dealer the next day haha. Ya know just for the hassle they caused.

    So the truck is back at dealer and your trade in is on their lot as well?

    To me asking to make it a certified used truck would have been worth it (if you love the truck)
    Free inspection of unknown mileage and 100k free warranty for 400 miles

    I know in my area its worth it to buy new compared to used since prices are so close, maybe why they were not going to knock off a few more grand

    btw i am going to be a stock broker tomorrow, ask me for some stock picks

    Same thing happened with me except I knew I was the second owner. Hence why I was out the door for $35k on a 2018 Tacoma trd OR with 500 miles.

    So....how many miles are on the truck now??
    Technically, after the deal reascends, sign all the paperwork....leave, and come back first thing in the morning, and buy it back as a used car.

    Well he bought from this dealership so dealership must have done something right initially.

    At least dealership didn't commit fraud and slip your signature on a new contract. when we bought our second house, builder signed a form for us and didn't tell us. oh yeah we were pissed.

    It's a mistake on their part and you should do what makes you feel better in the morning.

    I would want a new truck to start fresh.

    Agree. What can you hope to gain by stretching this out? What is your time worth, time away from working for your clients, not to mention the increased aggravation. Unless you have no clients and have nothing better to do.

    Just a couple thoughts.... You were happy with the truck and the deal when you thought you were the first owner. In my mind, you can't prove you suffered any loss until you actually do. i.e.- when you sell the vehicle.

    IOW- IF you being listed as the second owner hurts your resale value down the road as opposed to you being the only owner, you don't suffer any loss until you sell the truck, and you can reasonably prove you sold it for less than if you were listed as the sole owner, and determine how much less. In the long run, we're not talking $5 grand here, probably under $1K. And what happens to your case if you find someone who wants to pay OVER book value for your truck? Then you can't prove you lost anything, because you didn't.

    Most Toyota dealerships don't take a loss on their trades, so it's not like they lost money if they buy your truck but you don't buy theirs.

    Want to reduce stress? Have them cut a check for your trade and whatever else you put down and walk to another dealer. It's going to be a fight enough to do that, and it sounds like they are already too pissed off to give you a fair shake on any new contract.

    If your worried about a problem with the truck ask the dealer for the name of the first owner. I don't know California law, but in Wisconsin if the car is used you can ask for the name of previous owner. We did this a few years ago and I knew the previous owner. I wanted to see just how honest the dealer was.
