New Truck Wasn't "New"

    Ouch. Yeah, after knowing, you'll always know. I personally would refuse to keep it unless I got a huge free warranty.

    Also they probably bumped up your trade as much as they could to make the sale, potentially because it had 400 miles as a way to get you to sign. Of course they want you to take the trade back, so they can offer you normal rate when you go actually buy a new truck.

    And to top it off, you don't lose any tax advantages thanks to CA law for a trade in.

    If your severability clause is written how you think it is, congrats.

    Now go find another truck somewhere else, NEW, and negotiate it equal or below what you got yours for. Tell them you actually can get a new truck for X amount (because you did) and have them match or beat it.

    Same here in Nevada,even if the truck has 0 miles,you dont know what someone might have done to the truck,that's why the law was signed in.

    If it’s used you’ll have to smog every two years. If it’s new, you dont have to smog it fo 6. I’d take it back.

    Too few to list.
    When the deal is rescinded and they get your truck back, it would have to be sold as "used". So don't know why they are giving you a hard time in just giving you a price break on it. Which dealership is this?

    Have to respectfully disagree with this one. Regarding monetary loss, your arguments have merit. However, regarding value I have to disagree. For some, being the first and only owner of a vehicle has great value. In this situation, it could be that much more importance was placed on being the first owner vs the actual cost of the vehicle. Everybody’s formulas are different. For some, first ownership is huge.

    It's not his value he should be worried about. It's when he goes to sell his truck to a private party.

    Can anyone here honestly say if there were two identical trucks with one having a single owner and one having more, you would pick the vehicle that had more owners?

    Unless the above is true, the vehicle has reduced monetary value and he should be compensated.


    Someone at the dealer messed up and now the truck is worth less than it was when he signed the contract papers. If it wasn't his fault, he shouldn't have to eat that loss just to be a nice guy.


    Edit: I also wouldn't take back my trade in under his case. If even a single person entered his used car to do more than look at mileage, if they drove it more than 8 feet, if, if, if. It was out of his control, things were done without his permission, and the intent of the contract was followed through on his end... Then the dealer should follow through on theirs.

    Personally if I were them and I had a customer making a stink, I'd go find a new Tacoma somewhere, drive it around until it had 400 miles, then give it to him to fulfill the contract lol. And I'd be as gentle with the throttle as the customer was polite. But I would make it right.

    I am also glad I do not own a car dealership. Can't make money by having your employees drive some random truck in circles for 20 hours.

    Me, personally, I'd buy what truck I perceive to be the better value. Price and condition, period. One or two owners wouldn't matter.

    Yes, I agree to many people it does have value. However, how do you quantify that value in order to proceed in a civil matter? You can't, because it's subjective. You can't define it or put a number on it. Just my opinion.

    I think the paranoia over multiple owners is overblown. At some point in a vehicles life, especially when it exceeds 5 years old and/or 100K miles, people buying are going to be looking more towards getting a deal on pricing and shape of vehicle at sale. That is pretty much the physiological barrier when age and mileage takes it out of warranty and the number of previous owners is moot.
