    No gossip this time. @CVYota you will want to read this. I started my day, after having been in the er last night with high glucose and an anxiety attack, by being called into the office by my boss and his boss. The company pulled the trigger on me finally. I have 30 calendar days to find a different job here that I can perform with my restrictions. I still have to apply and go through the hiring process which usually takes at least a month to a month and a half. They are not willing to accommodate me anymore so if no job is found by 30 days I will be terminated and the long term disability process started. So I am being terminated for a disability I got working here. Life is good

    Pretty much but all the wondering is done now. This has drug on hanging over my head for about 10 months. It’s caused me other problems just stressing. Now it’s just a matter of figuring out how to move forward

    My BIL spent like 15 years fighting for work related stuff.
    Didn't ask for a lot.
    Ended up with pay compensation, lawyers fees all paid and in the end they settled for the amount he wanted 15 years later. So he made out like a bandit cause it's 15 years more of pay compressed in time..

    I hope your first call was to your attorney. Not sure what the requirements are in the ADA that allows them to refuse accommodation. SSDI is very hard to get they always come up with sedentary work , course that never pays what you need minimally. :(

    You still maybe able to negotiate that if you can't find a position and are forced to leave. That would be an attorney question.

    That's messed up !!! , and basically what happened to me with my shoulder injury working as Diesel mechanic !!



    As mentioned I had the same thing happen to me , I injured my shoulder ( rotator cuff ) in 2001and was out of work for 5 months . Went back to work and within a year injured the same shoulder ( rotator cuff) again plus torn brachial plexus nerve

    This time and after 6 surgeries and a surgeon damaging a nerve in my neck (Phrenic nerve) which controls my diaphragm . I was on workers comp disability from 2003 to 2013 and not being able to work . Finally I was found 80% disabled by workers comp and also after that was terminated by my employer

    Hired a Worker's Comp lawyer and after about 1.5 years I was awarded a huge monetary settlement . And to this day (7 years ) have been living off of

    Also besides the Worker's Comp injury I've also a disabled Veteran in which due to my service related injury to both knee's I'm rated at 80%

    Trying to find a job now sucks ( especially the now going on 16yrs since I last was employed ) as both of these injuries are hampering my ability to find employment !!!

    Yes a Malpractice lawsuit was filed !!

    And to this day I still suffer the effects of my partially paralyzed diaphragm . If I'm bending over let's say to tying my shoes I have the sensation of no being able to breathe

    I'm not a lawyer (nor did I stay at a Holiday Inn) so I won't try to quote law, but.....Been through similar with an employee of mine that a manager tried to fire. Get a lawyer. They MAY be violating federal law.

    I've tried to file for individual uneployability thru the VA for my service connected 80% disability but they said I can still seek gainful employment and was denied

    Same way with my workers comp injury I'm still able to seek gainful employment . I know if these were combined I could seek uneployability but was told I can't combine them !!

    Seeing how your current job, well more like work situation\managers\coworkers, put you in the ED last night yes it may be the best thing to happen to you. 3 more years going through what you are not sure you would be around long after to use any insurance benefits. The whole thing sucks and hope you get to stay some place else there to keep your insurance. But on a different team. Good luck and I agree talking to your lawyer was the first and best move to make. Pulling for you! Time will tell but don't think your next stop could be worse than the current situation your in.
