    So has anyone successfully won a claim for depreciated value due to a collision?

    *EDIT: without a lawyer***

    Fixing the damage is one thing but now the trucks record is forever blemished (I.e. Jon Jones, lance armstrong, Barry bonds, etc etc)

    You're correct. Well on most vehicles. Our bumpers are for looks only. The main "bumper" is the hitch . It's all plastic mounted to a thin piece of sheet metal. Corners are exposed which can add up fast to a total with a rear end minor overlap collision due to bed damage / cab corner. I'm in the collision industry and I've got a plate rear .

    Yup. Have become very well aware of the lac (lack of) proper crumple zones. One of the reasons I now drive an LX. And why the LX isn't going to be getting the bumper treatment.

    Hell, I don't even want to install a front winch as it would require removal/replacement of the front aluminium crash bar.

    Something like 25% of the drivers in Florida don’t carry insurance. I have sympathy, everything is expensive. I was just reviewing my insurance to make sure I’m covered for these types of situations. I’m now paying almost $2500 a year for insurance and only a few hundred of that protects my property, it’s mostly liability to protect my assets from lawsuits.

    We need to fix this situation though one way or the other. Perhaps a 10 year license suspension if involved in an accident without insurance.

    It was a MTB crash pad, for hanging the forks of my bike over the tail gate.

    Took it off when I got home to assess the damage (had to wedge a chisel between the tailgate and bed because the straps were pinched in so tight I couldn’t pull them out)

    Don’t get me started. Both of my accidents have been with at fault drivers without insurance.

    If it happens a 3rd time I think my full wrath will come out and I’ll get a lawyer to sue them into homelessness. Enough of me losing money on their irresponsibility

    I got about 3k diminished value on my old 1st gen. It was 18k new. Drove it off the lot and some ahole ran a red right in front of me and I hit him. My 1 day old truck went for repairs and I didn't see it for 2 months. Finally got it back, lifted it and never had another issue in the 12 years I had it.

    I found this in a Reddit thread.
    I'm a supervisor in CA that handles DV claims fairly regularly.

    Couple things that need to be pointed out first. You need to act quickly. CA is known for very low property damage limits and with the amount of damage to your truck it very well may have exceeded the other parties limits. You cannot claim DV against your own insurance company, the claim for DV has to go through the other party. CA says that if there is a limits issue and both you and your insurance have claims against the other parties insurance, you will get paid out first then the insurance. But for this to be true you need to notify them of your claim before they reimburse your insurance for the vehicle repairs.

    With that out of the way. Diminished value is hard to prove. The only way I see someone proving diminished value is to a) prove the pre loss value of your truck. Do this the same way an insurance company would. Find a sample of the same truck in your market area for sale and make reasonable adjustments based off differences in options and mileage.
    b) prove the post loss value of your truck. This is the same as in part a, except your comperable vehicles need to be ones that have been in accidents and have been repaired. This cannot include salvage titles as those are not comperable.

    Your diminished value is the difference between the two. I've never seen anyone do this. I've also never paid more than $10 in diminished value. But if I got a report with what I described above I would seriously consider it if the reports were accurate. The worst thing you can do is pay $350-$500 for one of the "professional" reports. Those get filed right in the trash with a standard denial letter because they fail to provide any evidence of the post loss value or the methodology for determining the DV, they just come up with a random number and bury it in a 20 page report so it looks professional.
