So many jokes come to mind, but I'll control myself. This really sucks. Not only did your fall, but your truck has serious damage. Hopefully you're all insuranced up on the truck and house. I hope it all works out for you

I can see the same thing happening, they are going to claim negligence on the homeowner and it will be a comp claim on your insurance. File a claim and let them figure to out, it won't effect your rates anyway it will be comp but your deductible will apply.

By the way... you said you smell oil. Any visible puddles under the truck, or stuff dripping anywhere?

This is true as many/most homeowners policy companies will try to use every trick in the book to get out of paying a claim. Seems they only want to pay out on a total loss, even then will try and say the policy holder was under insured, and try to underpay on the Percent they say one is "under-insured".

Ouch. I feel your pain. Sadly it is not a total your insurance will opt for repairs rather than pay full amount of the vehicle. Sorry, try to see if you can convince them not to label ur truck as salvage. Good luck.

Pretty sure you just contradicted yourself. If insurance fixes it is by definition not totaled. Totaled = salvage. Fixed ≠ salvage.

I know a lot of frozen rain can do this but curious- where do you live and what time, exactly did this happen? If you are in a fracking area, was there any possibility of a tremor when this happened?

If the furnace vents through that chimney make sure to get it checked out right away to be sure your family isn't getting gassed.

The insurance companies will work it out and cover the truck one way or the other, hopefully between truck and home owners insurance you won't be out of pocket for anything.

Best of all nobody was hurt which is nice.

A nice scooped hood would look great on that truck.....:anonymous:

I don't really want to read through 6 pages of comments, but if no one has made a Pink Floyd reference yet, shame on all of you.

Wow... lots of insurance misinformation here.

    1. This is an Auto (comprehensive) claim for the truck. Vehicles are excluded from Homeowners policies.
    2. The damage to the home (chimney, any roofing damage) is a Homeowners claim. The reason for the chimney failure is extremely important in order to determine if there is coverage.
    3. The Auto carrier will be interested to know the failure reason as well. If it is found to be negligence on the part of the chimney owner, they will attempt to recoup the cost of the Auto claim from the chimney owner. This recovery attempt may be addressed by a Homeowners insurance claim focused on General Liability.
Bottom line is: take LOTS of pictures (sooner is better!), and if someone was working on the chimney/roof save those invoices/receipts since one or more insurance companies will be very interested to see them.

    Good luck!

Interesting -- is this true in all states? Only reason I would ? this is -Why should his car insurance company be responsible for damage caused by a maybe defefctive chimney on the home?
