Body shop recommends repair not replace but I’m replacing. I will take the money and buy a sport hood

    He won’t be forever.

Op you handled it better than I would have.

I don’t know if it would have been me or him but someone would have had they’re ass beat if they hit my hood that hard.

As @mynewtoy said, he won't be forever. In fact, unless he actually punched out a cop, he could be home any minute, even right now.

You thought he was pissed about you speeding OP. How pissed do you think he will be about being in jail! Sorry, I am just stirring the pot. If he is still in jail he must have had a warrant or something. The police should also be in contact with you asking if you want to press charges, they should also mark your property damage in the police report. If that is the case I would take a copy of the police report to my insurance and let them go after the guy for the repair cost.

Too bad the OP wasn’t in Texas, the neighbor could’ve legally caught a bulletproof for that.

In most states, "comprehensive" coverage under an automobile policy would cover this with no deductible and no increase in premium. It's considered "no fault" by the insured, so if you have comprehensive on the policy make a claim.

I think you handled it the right way.

I know myself and some things I can let go and some I can't. Like you can scream and cuss me all day and I wouldn't take a swing but scream and cuss my wife and it's a fight.
I don't baby my truck but as much work as I have done to it. It's like a little brother. I can beat on it all I want but if someone else does there is going to be a fight.

Where I live usually when someone is convicted of a crime like this their sentence includes restitution. But that could be months before you see any of that money

I had a drunk guy try n e fight me once I didn’t fight back because I was sober and he was drunk wouldn’t have been fair plus I didn’t want to be responsible for his career already had a few strikes then being with alcohol plus he was a drunk

He would take swings at me and I would just take a step back and he’d miss completely and fall over

And that point I was thinking this would be like taking candy from a baby and just said I’m not fighting you , then he called me a bitch and walked off

*then I pulled out my gun and shot him in the back*

TLDR.... Him being in jail makes it easy for the police to get more info. Plus the cost of damages could impact the charges filed against him. You have two options.

    1) Wait for him to get out of jail, or if he has a spouse, talk to them. Make arrangements for a cash payment to repair/replace it. Get the deal in writing notarized. They may ask you to not press charges or something else in return, be careful, have a witness in all dealings.

    2) Call your insurance company. Tell them the story, provide the police report number, and let them do what they do. They have lawyers that you pay for to get the money. You are not at fault, so in most states that's means you can file the claim with no negative effects on you. Your auto insurance may suggest you go through your home/renters insurance, that depends on the local laws about insurance. Either way it doesn't hurt to talk to them and get real legal advice on what your options are, not a bunch of yahoos on the enter-web. You can talk to them without filing an actual claim.

If your insurance company gives you any shit about this, get a new insurance company. Seriously, this is why you have them.

Just curious OP, what were the charges that got him jailed? or was it already mentioned.
