    The laws in every state allow for employees to be terminated. There comes a point where the employee can't / won't do their job. Once that line is crossed every company in every state can start the process. If it's because of a disability the process is harder, as it should be, but it can be done. There is a lot of work and documentation required of the manager before any termination to keep the company out of law suits. There are probably other reasons why your company doesn't start the process of getting rid of him, but the state laws aren't one of them.

    Seems to be the majority opinion (on TW, in life) that EV spaces are of no significance. My EV would be parked with 1/8th of a micron between our door panels, happily charging.

    The most expensive thing a company can keep is a bad employee. They ruin moral, waste time of other employees fixing screw up's, and generally make the work place a miserable place to be. Everyone has worked with an idiot and did a little happy dance when they finally left. With out being his manager it's hard to know why he still has a job.

    Legally they can’t just fire him. When he comes in today the owner will offer him help. If he refuses help then they can let him go. Just like the last time he will take the help and go to some rehab for a month or two and when he’s done come back to work again. Trust me the owner doesn’t like it but he’s no dummy. He will be in his office with his lawyer this morning waiting for him to come in. Anyway back to the asshole parking! (Sorry I don’t have a picture to post)

    Maybe things are different where i worked. I had an employee that had a drinking problem. He and HR drew up a treatment plan/PIP and when he didn't fullfill it, he was fired. I don't think the law requires an employer to continue to put up with this shit if the employee won't cooperate, get help, and stop the behavior.

    Federal ADA ONLY requires a reasonable accommodation be made. Nothing reasonable about coming to work intoxicated every day. Don't know nuthing about this New Hampshire law.

    You can just fire a person, I've done it. There is a high likelihood of being sued, and I got the pleasure of going to court to defend the action. In this case the person had used their computer admin privilege to read a romantic partner's email. (office romance is always a bad idea.)

    ^this^ is what happens in any company I've ever worked for. Once you are on a Performance Improvement Plan (PIP) for whatever reason, it is a sure sign the bosses are documenting you out the door. Dealing with bad employees is the worst part of my job.

    Not trying to sound like a jerk but I don’t think you can compare reading somebody’s email to a drinking problem. And yes you can just fire them if you don’t mind getting sued. I don’t want to turn this thread into a big argument. Already had the meeting and he’s getting help.
