In California they are only liable if the rock fell off the truck. Rocks picked up from the road...not liable.

It was literally a half a second, we were passing at opposite ways going around 45-55mph. I didnt think to look at the truck until I saw the rock come flying up from it, I wanted to turn around but it was unsafe to do so.

My camera image is all I have to go off of. I know it ain't much, but I figured there are some of you guys out there who are gurus at this. I'm hoping if anything I drive by it again since I take the same route home everyday.

Odds are that is a owner operator that doesn't have a website. If you can't handle paying your glass deductible go sit in the spot it happened and wait for the truck to drive by again, then follow and talk to him about it.

Afternoon... I have been in the trucking industry, hauling construction equipment for my entire professional career. I'll tell you that 90% of complaints from motorists trying to claim that a rock "hit their windshield" are not valid complaints. If the rock comes from the roadway, the truck driver nor the trucking company is responsible for the damage. Just like if it came off the roadway and was kicked up by the Honda Accord or Silverado in front of you, or even your vehicle. So to respond to your statement... I think most people read this like I did... "I want a free windshield, because I think that rock came from his truck and I shouldn't have to pay for it".

If you have a valid argument, they should replace it (If they turn it into their insurance, the claim $$ would be so insignificant it shouldn't make a difference on their premiums). I have paid for many windshields for people with a valid argument.

But I have also replaced my own windshield many times, because rocks exist. Sometimes, they hit my windshield. Stuff Happens.

Thank you for your insight. Like I mentioned previously, the truck was also driving out the lane on the turn and into the gravel. If I have a case then thats great, new windshield, no hard feelings no one was hurt. If I have no case thats fine too. But if there is a way to replace my windshield lawfully I am going to pursue it.

When you say the truck was out of the lane, what do you mean? If it was a narrow road trailers "cheat" as they do not follow directly behind the truck, and if it was narrow, odd are the trailer swung over the line into the gravel as to keep the truck in the main lane and not swing out into the oncoming lane to keep the trailer on the road. Most insurances have really cheap deductibles on glass that won't affect premiums, why not just go that route.

I would give it a shot, my parents had their windshield cracked by a rock shot by a semi truck, they got the name and went right directly to the company and the owner said he felt obligated to pay for the replacement,

Well good luck, I'm rockin the broken windshield, I neglected to add the glass insurance when I set my policy up. So instead of 50 bucks its 500 to replace and I said f*ck that.
