Did they intentionally place a rock in their tire to break his windshield? Highly unlikely

yes and my life is cold and uncaring, just like the trucking company who disses the public when a complaint is lodged against them for not being truthfull and taking peoples damages seriously

Most car accidents aren't intentional either, but whoever caused the damage is still responsible for fixing it. It was at least worth it for the OP to contact the company and ask. What's the harm in that?

Time is valued differently by each person. Heck, here we are on TW spending time chatting about something that's only relevant to me. Your time may not be valued very high then.

    Hey Livin,

I've been down this path with a similar incident. I had a construction barrel (tipped over) get blown out into the path of my Lexus and it smashed the front bumper and headlight. I pulled over to get the contact for the construction company. They were a contracted construction company working on a WSDOT project. They both kept passing the blame back and forth and despite filling out all of the reports and claim applications, I got no where. I even had a police report stating fault with the construction company.

Eventually I got tired of fighting with both parties and had my insurance company cover the damage as a "non-fault" claim. It didn't' drive my rates up, as I was found to not be at fault. I still get letters from my insurance stating that they are still working at recouping my repair bills (over a year later)... if they ever get their money, I'll get my deductible back.

Good luck with your claim, but in reality, I think you're SOL.

Also, I personally wouldn't be blaming the trucking company, unless the rock came from their load. As for blaming CalTrans... Gravel on the side of the road is hardly their fault. Ultimately, it's just bad luck and you should probably just chalk it up to that.

You gave it a valiant effort, and good work using the forum to locate the truck! It is very similar to the story I posted earlier on page 6. I wish you would have had a better outcome than I did. Hopefully they can fill your windshield cheaply. Mine was leaking and had a huge duct tape patch on the inside of a few days until the replacement came in. I still have the email chain from the company that caused mine, including the one where the company's safety officer implied I was a scam artist. That prick! I hope he catches VD. I was literally covered in glass shards and am lucky none of them embedded in me. Don't blame you at all for trying. On the other side of the coin though, every time we go out on the road we assume risk and I am just grateful I had my sunglasses on and the windshield kept the object from braining me. I do need to look into a flat out glass replacement policy and have been researching dash cams.

You can't just put a sticker or sign on your truck and absolve yourself of damage caused by crap falling off of it. I've seen those signs, and most of the time you couldn't even read the sign at the distance quoted.

Proving something came off the truck is where it gets tough, but dashcams are cheap and easy to install.
