Dealer "forgot" to charge sales tax on sale?

    Fuck that. It was dealer's obligation to collect the appropriate sales tax and they failed to do so. Now the Agreement has been signed. That shit's on them now to remit it to the State. Tell them to go eat a bag of dicks.

    That’s not how it works in every state. NJ for example it is either paid in cash at signing, or rolled into the financed amount. It’s not separate on the payment due like some states

    Yeah, r/legaladvice has been helpful...I'm in agreement with most here though. You already signed, paid money towards even...technically, any financial aspect would/should be dealt with through the financial institution you have your loan through...even if it's Toyota financial services. Not the stealership....I mean dealership. If they goofed, they need to eat it....not you. Especially if you have a signed contract with the bank. The dealership is the middleman in that situation...they're just trying to cover their asses.

    He's being nasty because he goofed and his boss is most likely saying that it's coming out of his commission check unless he can get the customer to resign. Again, that is shady on their part...sounds very...ummm how should I put it....scamy lol

    This is my understanding as well, not the other way around as has been mentioned. I guess it depends on the particular state though.

    Also - Read through your itemized costs and make sure the dealer isn't scamming you.

    Im pretty sure it's considered Personal Property Tax. You'll pay it when you get your registration, at the county. You are not getting off sorry. All the dealer is doing is collecting sales tax for the county anyway. That's why rates are different for different counties. All the dealer does is collect it and submit it. Tax is common knowledge, this is on you OP. You'll pay.

    So if contract is needing to be redone, take the amount of the sales tax and subtract that amount from purchase price of truck

    You’ll owe it to the state anyway. It doesn’t go to the dealer. They’re not trying to screw you. The state will get their money from you easy or hard way

    Freegolf - Depends on what state you live in.....Ohio has no personal property tax on vehicles. Sales tax only.

    What state are you in OP? I think it depends on the state as to whether the dealer is responsible for collecting the sales tax on the vehicle they sell or vice versa.

    Depending on what state he's in, it's not absurd at all. In some states, the responsibility to collect sales tax is on the dealership.

    You signed off the contract but did you get the title from them? If not they could hold it back saying you still owe the finance co.

    I am an attorney but this isn’t my area of practice. Contract law is generally a matter of state law. Check to see if the contract states that you are obligated to pay sales tax (even if it’s not collected by the dealership).

    Sounds like this a rampant/borderline unethical practice though. When have you ever bought anything without the company assessing sales tax? Virtually never... except car sales.

    I’m no lawyer, but you have a signed contract from the dealer. It’s their mistake they should eat it. The deal has been done.
