Dealer "forgot" to charge sales tax on sale?

Can you look this up online? In Minnesota we can go to the DMV site and enter the plate # or driver's license number to see when tax was paid and how much. I use this feature for itemizing my income tax deductions (not that it is worth it anymore). I'd start there.

That’s a good point. I was thinking that the taxes just hadn’t been collected. If that’s the case, screw them...

 

Pennsylvania- Motor vehicle sales tax is paid directly to the Department of Transportation, which acts as a collection agent for the Department of Revenue. Vehicle dealers, leasing operators and private individuals who pay the motor vehicle sales tax to the Pennsylvania Department of Transportation at the time of title application, may not take the vendor discount on line 4 of the Sales tax return for timely filing offered to other accounts who collect and remit sales tax directly to Revenue.

 

This would be sales tax then, and the dealer is responsible for collecting it. Not a lawyer, but i think it’s on the dealer. They wouldn’t be calling you trying to get it if they could pass it off to the state.

 

Depending on how tags and registration are handled in your state if the dealership gave you a temp tag and are processing that for you they could hold your tags from you until you pay. I sold cars for a bit and the dealership was in a shitty area so we were always calling to "remind" customers about things on what we called a we/you owe like titles from trade ins and down payments. Had to hold tags numerous times due to people just being difficult and not holding up their end of whatever deal they made.

 

Call the state tax people (Your state) Tomorrow and get someone who knows the rules ( not just the first one to answer the phone and speak to them . With that info then decide your course of action.

In Mo. our "MODOT" only builds and maintains the roads, thank God they don't handle the sales taxes!

I work as an auto loan officer at a local credit union and I am going to agree with you on this. I've seen this happen before and IIRC the buyer had to cough up the money. The sales tax is essentially between the state and buyer of the auto. The dealer is doing the state a "favor" by collecting sales tax. If you do not pay the sales tax on that auto you will not be able to get your tags or registration which can lead to a lot more problems down the road.

In KS, if the dealership collects sales tax, they issue you a form of some sort stating the sales tax has been paid that you give to the DMV when you get your plates. This puts the dealer on the hook. If the dealer did not pay the sales tax, you won't have this form. Then the DMV will make you pay the sales tax to get your plates. I'm guessing this is similar in states that allow the dealer to collect sales tax.

How else would DMV know its been paid unless some sort of electronic system.

 

I owned my own car dealership for 10 years. It’s their problem that they are too damn stupid to charge sales tax. In Utah you can’t withhold license plates due to non payment, I’m not sure what your state laws are. Since he’s an asshole, tell him to stick it. Your signature on the contract was in agreement to notes terms, which includes zero sales tax.

 

I agree with this route. Worst case, you pay the DMV. Best case, dealer eats it.

 

How the heck does anyone here know what the rules are in Pennslyvania --that is unless you are from there. He needs to talk to some one who (not the dealer) KNOWS The state laws period!!

 

When I bought my Taco, the dealership told me I could save a few bucks off their fees if I handled my own registration/taxes. Meaning they wouldn’t collect it and I would be responsible for it when I went to register my truck. Sounds like they did it and didn’t charge you for it. . . Interesting.
