Dealer "forgot" to charge sales tax on sale?

    In many if not most states, there is language to the effect that the end user pays the sales tax. If the dealer, for whatever reason, mistake or not, failed to collect on behalf of the state, the end user, you, still owe the tax. Here in L.A., Samy's Camera, the largest camera store chain in California, regularly has "No Sales Tax" sales where the manufacturers pick up the tab for the sales tax. This is the only legitimate non-payment of sales tax I know of, but the state still gets their due, just not from you. Unless your dealer was advertising something similar to what Samy's does, you're going to have to pay the tax, and the sooner, the better. You KNOW what the right thing to do is. Is an illegitimate three grand really worth it?

    I think it is common for finance guys to try to push you in to an extended warranty by holding back a lower interest rate. When one did this to me I said "would you have offered that rate without warranty"? When he said yes I said fine I will take it.

    Just skimmed through the 9 pages, this may have been said already. Every state is going to be different. For instance, businesses can't advertise "we'll pay your sales tax" in Indiana. They have to say, "we will discount you the amount you pay of your sales tax", but you have to pay it. You really need to consult an attorney, not take internet advice.

    My fear would be that when the state doesn't get their taxes, they will refuse to issue registration and/or title. I think that is pretty common across all states.

    What I haven't seen discussed is if they arrived at a price the person could afford, and no more, and this is why the deal was made. 3k is lotta dough to be thrown at you like a curveball, weeks later, to alot of people.

    What if they agreed on a price OTD including all fees/tax and that was the final price on the contract. However in this case the dealer left the tax line out of it when the purchaser thought that everything was all set at $xxxx. Now the dealership is informing him that is is really xxxx plus sales tax when the agreed upon final price was really the price on the signed contract. In this case it wouldn't be the purchaser getting away without paying the tax, but the dealership screwing him on the purchase for the amount of sales tax.

    lol OP edited the post and quite honestly I doubt OP will be truthful no matter how it shakes out, they probably got the letter and won't mention it or will end up paying the taxes and come back and say they "won" anyways. People lie on the internet all the time about the deals they got, its weird because we don't actually know them so who cares but people do it all the time.

    Every dealer I've ever known has an automatic system that sends the letter on ANY deal that hasn't been funded no matter what the issue. 50% of the outgoing phone calls finance managers make is to tell people "we have to send this letter but don't worry everything is ok you can ignore it".

    Furthermore this vehicle was never actually registered to the dealership and we're not talking about financing or pricing, the dealer was acting as a broker in transferring the loan to a new lender, the registration never changed, its about TAXES which OPs owes and he knows it.

    Either way the bottom line here is OP owes a tax that THEY knew about, THEY signed for, and are now trying to weasel their way out of responsibility. This isn't a "scam" or a "rip off" this is someone trying to take advantage of an honest mistake to skirt something they know they're responsible for.

    If you're cool with that and would do the same thing, it says a lot about your own integrity.

    You're acting like the dealership was selling him one of their used cars and making a profit.

    They transferred the loan on HIS OWN vehicle. There was no "agreed upon price", thats like going to refinance your house and calling the amount you owe "the agreed upon price" lol, its not "agreed" its literally just WHAT YOU OWE.

    Its incredible how childish all you grown "men" are behaving, if anyone pulled this shit on any of you you'd be crying about it but when it happens to someone else your minds are focused only on how you can screw them, so weak.

    In GA, the dealer ship is simply collecting the tax to submit to the tag office on behalf of the buyer so they can mail him his tag. They do this so they can get the proper lien holder info to the tag office also. If it wasn't collected at the time of signing, then the buyer is responsible for doing this and getting their own tag. The OP looked at this financing contract and buyers order where the tax wasn't included and still signed. That's on him. If he can't afford the taxes out of pocket and wanted to financing them, then he needs to resign some docs with them included. Very simple to do. It is in no way the obligation of the dealership or the person who closed his deal to pay for the taxes. This would be a different case if he signed paperwork that had the sale price lower than discussed and then the dealership is trying to come back to get him to resign paperwork with a higher sale price... Then is SOL for the dealership.

    No I'm not a lawyer but have been in the auto financing industry for the past 8 years.

    That is why a buyers order is written the way they are. All things are itemized so you know what is the cost of the vehicle and what is tax. It's on the OP to look at this to make sure its correct no matter what was told to him in negotiations. It's not just a sheet of paper he signs with the total price that says $xx,xxx.xx out the door price.
